Rob was recently part of a team of HPTY business litigation lawyers that obtained a hard-fought preliminary injunction proceeding under the Lanham Act in the Northern District of Georgia on behalf of Osmose, Inc., a leader in the wood preservation industry. The ruling followed a week-long evidentiary hearing and enjoined the Defendant from continuing with a pervasive, negative advertising campaign designed to destroy one of Osmose’s product lines. At the same time, the team successfully defended the Defendant’s retaliatory attempt to enjoin certain advertising claims made by Osmose. The key provisions of the order were upheld on appeal by the 11th Circuit Court of Appeals..
