Steve’s practice focuses on advising clients on land use and real estate matters relating to a wide variety of residential, commercial, and industrial developments. He assists clients in obtaining all types of land use approvals, including mining permits, shoreline permits, building permits, hydraulic project approvals from the Department of Fish and Wildlife, and aquatic lands leases from the Department of Natural Resources. This assistance regularly includes litigating administrative and judicial appeals of land use decisions. Steve has extensive experience with surface mining projects and shoreline developments, and in helping clients efficiently complete the consultation requirements of the Endangered Species Act, in order to secure permits from the Corps of Engineers. He also frequently assists clients with wetlands issues, easements, rezones, condemnations, and local improvements district (LID) assessments.

During his tenure, Region 10 successfully negotiated the Tri-Party Agreement for the remediation of the Hanford nuclear facility, managed the cleanup of the Alaska Oil Spill, and numerous other significant environmental matters. Mr. Russell also led USEPA delegations to the People's Republic of China, the Philippines, and Canada, and was a member of a delegation of scientists and legal professionals who visited the Soviet Union and Poland, including the nuclear site at Chernobyl. Prior to his federal service, Mr. Russell served as a Deputy Attorney General for the State of Idaho, heading both the Natural Resource and Local Government Divisions. Prior to law school, Mr. Russell served as Administrative Coordinator for the Idaho Department of Environmental Protection and Health. He received his undergraduate and law degrees from the University of Idaho, and has received training in arbitration and mediation through the American Arbitration Association. Mr. Russell is admitted to the bars of Idaho, Washington, and all federal courts. He is also a member of environmental and land use sections of the Idaho and Washington State Bar Associations and the Natural Resource and Environmental Sections of the American Bar Association.

Nick has extensive civil litigation experience and he is admitted to practice in the State of Washington, the Western Federal District Court of Washington, and the Ninth Circuit Court of Appeals. His practice currently focuses on CERCLA and general litigation matters.

My practice focuses on environmental law and related litigation with emphasis in hazardous waste regulation, remedial action and cost recovery, and Clean Water Act permitting.  I have represented and counseled clients on a wide array of regulatory and compliance issues in multiple environmental areas (CERCLA, RCRA, MTCA, Clean Water Act, and NEPA).  As a former Special Assistant US Attorney with the Environmental Protection Agency, I have extensive experience in all aspects of RCRA hazardous waste regulation and Part B permitting, CERCLA and MTCA remediation and cost recovery, and Clean Water Act NPDES and Section 404 wetlands permits.

Mike has been licensed to practice law since 1986 and his practice emphasizes real estate transactions, land use/zoning, alternative dispute resolution, litigation and school law. A signifncant part of his practice involves advising property owners on waterfront property issues.  He is a certified mediator and arbitrator, a licensed real estate law instructor and 2012-2013 President of the Bainbridge Island School Board. He frequently serves as a Court-appointed referee on real estate matters.  Prior to entering private practice, Mike represented the Realtor® organization to local, state and federal legislative bodies, and in that capacity, he has had a hand in the drafting of many major pieces of real estate-related legislation.. Mike studied planning and economics at the University of Wisconsin and worked as a Planner and in the title insurance industry before becoming licensed to practice law. Because of this combination of experience, Mike was invited to Shanghai, China to consult with housing and land use officials on regulation of real estate markets, and he subsequently took a one-year leave of absence from Harrison, Benis & Spence to serve as Lead Attorney for a USAID and World Bank-sponsored land reform project in the former Soviet Republic of Moldova.. Mike’s passion is education, and since 1994 he has taught real estate law and related topics to brokers and others for North Seattle Community College, the Rockwell Institute, the Seattle-King County and Washington State Realtor® organizations and every major brokerage in Puget Sound. Linda B. Clapham, a principal, re-joined Carney Badley Spellman in March 2013.  Ms. Clapham has extensive insurance coverage and litigation experience, on behalf of both domestic and London Market Insurers. Andy’s practice spans many disciplines including environmental, real estate, land use, and construction law. He advises clients on regulatory compliance and litigation of cost recovery and contribution actions under the Washington Model Toxics Control Act (MTCA) and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Andy has successfully managed the environmental remediation and regulatory closure of several complex contaminated sites.
