My principal practice areas are real estate law and business law, with particular emphasis on commercial leasing, the acquisition, management and sale of properties, financing transactions, commercial loan workouts and residential and commercial development. My clients include commercial landlords and tenants of retail and office space, private and institutional lenders, hotel and restaurant operators and brokers. I am most proud of the fact that my clients often credit my responsiveness and business acumen with maximizing their business opportunities and minimizing their financial and legal risks. When not at work, I am active in the community. I am a member of the North Shore and Cape Ann Chambers of Commerce and have served as a member of the Advisory Board of the Wheelock Family Theatre and a board member of Newton Youth Soccer.

I  have over 30 years of experience in all aspects of commercial real estate transactions, including acquisitions, sales, financing, leasing, loan work-outs and restructuring, debt assumption, and joint venture activities. I have represented a wide variety of clients, including banks and other financial institutions, equity investors, and owners and developers of retail centers, office buildings, hotels, condominium developments, multi-family residential property and mixed use developments. In addition, I have experience in sophisticated financing transactions including construction and mezzanine financing, loan defeasance, and loan portfolio acquisitions.

I have over forty years experience performing a full complement of services to the real estate, hospitality, and finance industries specializing in acquisitions, sales, development and complex financing transactions. I have currently added specialization in the placement, evaluation, and closing of real estate and asset-based financing, including substantial work in the purchase of loan portfolios and in loan restructuring. This experience includes representation of buyers, sellers, and developers in complex transactions from Maine to Florida together with representation of institutional and fund lenders.

I am a trial attorney practicing civil and criminal litigation in state and federal courts including the district, superior, and appellate courts as well as civil litigation in the Land Court.  My practice includes general business litigation, real property and title claims, tax abatements, brokerage disputes and employment law.  I have significant experience in criminal law as a former Assistant Attorney General in the Criminal Division of the New Hampshire Attorney General’s Office prosecuting white collar crimes and homicides, and as a criminal defense lawyer with a Massachusetts firm before joining Bernkopf Goodman in 1981.  During my career, I have tried numerous jury cases, and have substantial appellate court experience, and have been a frequent participant in the resolution of cases through mediation.  Recently, I obtained a substantial jury verdict in Suffolk Superior Court in favor of a real estate brokerage firm, successfully represented a national title company in a lengthy arbitration proceeding involving a title dispute with a golf course owner, and on behalf of a securities firm and its broker, favorably resolved through mediation an investor’s claim filed in an arbitration proceeding with the Financial Industry Regulation Authority.

David A. Libardoni is a partner in Nutter’s Real Estate Department and a member of the firm’s Development, Land Use and Permitting practice group. His practice focuses on complex commercial acquisitions, dispositions, joint venture, leasing, and financing matters as well as land use and permitting matters, with a particular expertise in representing owners and developers in the full life-cycle of a real estate development, including significant life science, mixed-use, multi-family and industrial and warehouse projects.

Commercial real estate development from a property in its raw state through acquisition, development, and sale comprise my primary area of practice. My practice includes acquisition, permitting, construction, leasing, financing, syndication, title and sale of real property.  It is my goal to offer my clients creative approaches for each transaction in which I provide representation.  I am a former member of the Sharon Planning Board and Sharon Zoning Board of Appeals as well as of the Dover Housing Partnership, so I understand both sides of local permitting issues, and I appear on behalf of clients before Zoning Boards, Planning Boards and Conservation Commissions.  I am currently Chairman of the Dover Zoning Board of Appeals.  My clients include developers, corporations, institutions and small businesses.  I have been a licensed multiengine commercial pilot since 1981, and I also assist clients in aircraft acquisition, financing and sale.
