My practice is concentrated in the area of civil litigation. My primary area of practice invovles creditors, secured lenders and equipment lessors in a variety of commercial matters. I have defended a large number of lender liability cases for banking clients. I also litigate more general business torts, contract disputes, trademark and trade secret litigation, real estate cases, and insurance coverage litigation. Previously, I served as a Public Affairs Officer at the Consulate General of Israel to New England, working directly with U.S. and Israeli universities, students and faculty.
I have developed my practice over the past three decades, focusing primarily on bankruptcy and insolvency proceedings. I often represent individuals and small businesses, secured and unsecured creditors, committees of creditors, trustees and equity security holders in bankruptcy and insolvency proceedings as well as financial institutions and other lenders in out-of-court loan restructurings, assignments for the benefit of creditors, foreclosures, repossessions, and the sale of distressed assets and businesses. I also have experience representing business debtors in workout, restructuring and bankruptcy matters.. I have extensive experience in all facets of cross border insolvencies and cross border insolvency litigation. I am regularly engaged by private equity firms, governmental agencies and estate representatives to advise and counsel them on a wide range of cross border insolvency issues, with particular emphasis on United States/Western Europe jurisdictions.. Over the years I have cultivated extensive knowledge and skill in commercial and complex business litigation including veil piercings, corporate officer and director liability, successor liability, fraudulent conveyance and transfer litigation and constructive trust litigation. I have experience counseling clients on distressed M&A transactions, corporate governance issues and complex business restructurings. I also have significant experience representing financial institutions in workouts and foreclosures of aircraft and related international equipment and have repossessed aircrafts in various states throughout the United States.
Concentrating in creditors' rights and business insolvency, Jim represents banks, hedge funds, leasing and finance companies, commercial landlords, trade and other creditors in enforcing their rights in all manner of workout, debt restructuring and insolvency proceedings. Jim has also served as counsel to Chapter 7 and Chapter 11 bankruptcy trustees and he has served as counsel to creditors’ committees in Chapter 11 cases. Jim has also represented sellers and purchasers of assets in bankruptcy proceedings. Jim has served as a state court receiver and has represented secured creditors in receivership proceedings. Jim has appeared before various state and federal courts throughout New England. He has appeared in bankruptcy courts throughout the United States.. Jim served as law clerk to Thomas W. Lawless, Bankruptcy Judge for the United States Bankruptcy Court for the District of Massachusetts. He is a member of the Massachusetts Bar Association as well as the American Bankruptcy Institute.
