This investigation was closed without criminal charges being brought. Over the past several years, Kent has represented clients in criminal investigations and trials on behalf of the coal industry. In particular, Kent has been involved in the Crandall Canyon Mine disaster where an investigation was conducted by the Mining Safety and Health Administration ("MSHA") and the United States Attorney's Office in Utah. In the past, Kent was involved in representing executives in the Pyro Mine disaster where no charges were brought against his client. More recently, Kent obtained an acquittal for a coal mining executive in United States v. B&D Mining in federal court in Abington, Virginia. Kent has also obtained a significant judgment of acquittal for felony counts, post verdict, in United States v. KenAmerican Resources, et al. for his client who was a mine superintendent. The court ultimately sentenced this client as well as others to probation after a month long jury trial.  Kent recently obtained an acquittal for an environmental compliance officer in Ohio v. United Wastewater.. Kent and his firm have handled virtually all types of White Collar matters. Kent has represented clients in matters involving  state and federal tax violations, mail and wire fraud, healthcare fraud false statements, RICO, government contract fraud, environmental crime, money laundering, securities and insurance fraud. Kent has represented state court judges, attorneys, physicians, and other professionals in criminal investigations. Kent frequently advises businesses, municipalities and individuals in responding to requests for documents and records from grand jury subpoenas. Early in his career, Kent obtained an acquittal for an accountant in a criminal tax prosecution, United States v. Schultz. These prosecutions have involved substantial post trial briefing as a result of the recent Supreme Court decision in Skilling as well as alleged Brady/Giglio violations resulting from the government's failure to produce exculpatory and/or impeachment material in advance of trial.. Kent served with distinction as an Assistant United States Attorney for the Western District of Kentucky from 1981-1987. Kent has also served as a Special Justice of the Kentucky Supreme Court and as Chairman of the Civil Justice Reform Act for the United States District Court for the Western District of Kentucky. He is a currently a member of the Board of Directors of the Federal Public Defenders Corporation. Kent is a Life Member of the U.S. Sixth Circuit Judicial Conference and a member of the American Board of Trial Advocates. Kent has served in 2011 as Chairman of the United States District Court Magistrate Judge Merit Selection Panel, United States District Court, Western District of Kentucky – Louisville Division.  He currently serves as Chairman of the Kentucky Bar Association Mentoring Committee.

I learned that trying a case well is a skill that can’t be learned just from books.  It takes a  lot of experience in a courtroom to really develop the ability.. I have now been a trial lawyer for over 27 years.  My first jury trial took place in 1987-an acquittal on a DUI case.  Since that time, I have tried many cases in both State and Federal Courts ranging from murder and drug trafficking down to accusations of stealing a pack of gum from Krogers.  Most cases settle without the need for a trial but I believe my clients receive more favorable offers of settlement because Prosecutors know that if an offer is not fair, I will not hesitate to go to trial and that I have the skills and experience to obtain a favorable outcome.
