Mike has been with Vial Fotheringham since 2002. In that time, he's worked with other members of the firm on a number of complex litigation matters, including several of the largest residential construction defect cases in Oregon history. I handle a relatively smaller number of cases and provide very individualized attention to each of my clients. I never lose my professional objectivity in analyzing the strengths and weaknesses of a case. I will listen carefully to a client, then lay out, in plain English, the various options available to them. I will weigh many factors when rendering an opinion as to the best way to proceed, including which judge has been assigned to your case, the county in which the case has been filed, the reasonableness of the lawyer representing your spouse/partner, the financial resources available to each side, recent appellate caselaw which pertains to your case and the likelihood of success. My practice is limited to the tri-county area (Washington, Multnomah and Clackamas County). I have been practicing law for 41 years, almost exclusively in the area of family law.  I have won custody cases in which almost everything seemed to go against my client. I am adept at articulating the winning argument, but am also careful to advise my client of the risks involved before proceeding. I usually try to work out a settlement to save my client the expense and emotional turmoil of trial, but if I believe the other side is not willing to negotiate in good faith, or is making unreasonable demands, I will fight tooth and nail for my client in court. In turn, I will tell my client if I believe he or she is being unrealistic or unreasonable or is at risk of having the judge order them to pay the other side's attorney fees. I have a relatively low hourly rate, given my many years of experience. BACKGROUNDI began my career prosecuting criminal cases in an historic courthouse anchoring a sleepy, Southern town. Then, as a Marine Corps Judge Advocate, I defended service members in court-martial proceedings out of a spartan, block building aboard a California desert Marine base. Living and practicing in the majestic Pacific Northwest for over twenty years since then, the offices and scenery have improved dramatically.. No matter the surroundings, though, the mission has remained the same: helping good people through difficult situations.. My practice has evolved and expanded from criminal and civil litigation to include an emphasis on entertainment and intellectual property law for creative professionals, as well as business, real estate and contract law for Oregon businesses. My clients include artists, writers, producers and content creators in Oregon’s film and TV industry, as well as small business owners in multiple sectors, including those in the burgeoning Oregon cannabis industry.. In my spare time, I stay active in the community as a youth and high school sports official, and as an adjunct instructor teaching law classes to paralegal students.
