I have been practicing law in Seattle since graduating with honors from Seattle University School of Law in 1998. My practice focuses primarily on estate and tax planning, probate, trust and estate litigation, trust administration, prenuptial and postnuptial agreements, domestic partnership agreements and succession planning and business transactions. I also co-founded and partnered a local tax, business and estate planning firm in Seattle.. Over the years, I have represented a wide range of trust, estate and probate clients, working to assist them in their personal and tax planning needs. Additionally, I have represented beneficiaries, personal representatives and trustees in estate litigation, both in defending fiduciaries and in bringing actions against fiduciaries.. As a member of the editorial board for the Real Property, Probate and Trust section of the Washington State Bar Association (WSBA), I have written articles and presented materials on topics ranging from tax filing to nontraditional family estate planning. I am a member of the Estate Planning Council of Seattle and a member of the Tax Section fo the WSBA.. Prior to attending law school, I spent over eight years as a stockborker, regional sales manager and vice-president of a local brokerage firm. My background gives me an understanding in financial and economic issues, as well as hands-on experience in dealing with the personal planning needs of individual clients.
I have been an attorney at HCMP since 1982, having arrived in Seattle from the boom town of Buffalo, N.Y., following law school and college on the east coast. As dictated by the then prevailing real estate environment, I spent my first seven years dealing primarily with workout and bankruptcy matters. As the real estate sector of the economy improved, I shifted to transactional work, mostly financing transactions and loan syndications. I have found that, working through some troubled times has given me a great perspective on what's really important when "push comes to shove" in a transaction and, with the recent turn in the economy, my early experience has been a true resource in handling the restructuring and workout of troubled loans and in advising clients in creating effective strategies for realizing on their security. I regularly advise our clients, including a number of financial institutions, in lending, real estate, and related debtor-creditor matters, and supervise attorneys and paralegals providing assistance in the full spectrum of financing and real estate-related areas.. In addition to almost 30 years of experience assisting our clients in addressing their legal concerns, I have spent considerable time working with industry and trade groups in ways that have helped me gain a broader perspective on the issues my clients face on a daily basis. Those in the lending industry have even shown enough confidence in my judgment to elect me President of the Seattle Mortgage Bankers Association and an Associate Director of the Washington Mortgage Lenders Association, and I continue to be involved with both organizations on an ongoing basis as Chair of their joint legal-legislative committee.
I grew up in Tennessee and received my college and law school education at Southern Methodist University in Dallas.. From 1970 to 1974 I practiced with the Navy Judge Advocate General's Corps in Vietnam, Pearl Harbor, and other duty stations afloat and ashore. Following my tour of duty, I became an associate with Mullavey, Prout in 1974.. My practice is predominantly personal injury trials, estate planning and probate, insurance, maritime and general litigation. I have tried numerous jury and non-jury cases in state and federal courts.
I greatly enjoy and cultivate a general business and personal injury practice, with long term client relationships going back to 1979, when I relocated from New York City to Seattle (where I am a native). I purposefully maintain a small law firm practice, with an emphasis on providing excellent service, so that we can hopefully continue a mutually profitable relationship in the future.
I focus my practice on the representation of property owners whether corporations, limited liability companies, individuals or homeowners associations. I am chair of the Construction Practice Team, serve on the Williams Kastner board of directors and am chair of the Loss Prevention Committee. My recent trial success includes representation of General Metals of Tacoma, Inc in a contract dispute with its general contractor, Bean Environmental, LLC, on an environmental dredging project to remediate the Hylebos Waterway in Tacoma, Washington. Following a five week jury trial in the United States District Court in the Western District of Washington, the jury awarded my client $6.37 million for damages sustained as a result of the general contractor’s failure to perform its contract obligations. The decision in General Metals of Tacoma, Inc. v. Bean Environmental, LLC was upheld by the Ninth Circuit Court of Appeals in November, 2008.. I have handled cases in King, Snohomish, Pierce, Thurston, Grays Harbor and Grant County.. Outside of the office, I love running forest trails, diving into books and music, and spending time with family at game nights.
I enjoy Estate Planning because it is an area of law in which I can help clients solve problems before they occur, instead of helping them pick up the pieces in an already frustrating situation. The nature of estate planning also makes it possible for me to really get to know my clients and form a relationship of trust. Taking the time to learn about my clients' values, families, and circumstances helps me design an estate plan that will give them a sense of peace. I also do probates, because I love to help people at critical junctures in their lives, such as following the death of a loved one.
