The Terry case involved the tragic drowning death of a five year old boy who was attending a Vacation Day Camp at the YMCA of the Shoals. Plaintiffs contended that the child drowned as a result of negligence by the YMCA’s aquatic and childcare staffs. The YMCA contended that the child’s death was an unavoidable accident. A Lauderdale County jury awarded the plaintiffs $2,500, when the case was tried. The verdict was the second largest jury verdict in the history of Lauderdale County.Mr. Cross represents plaintiffs in various types of cases including wrongful death, trucking litigation, drug and medical device litigation, toxic exposure, products liability, nursing home neglect, insurance fraud and bad faith, automobile accidents and work related injuries.
