Before becoming an immigration lawyer, I worked as a journalist for the Miami Herald and Newsday. I also spent two years as a foreign correspondent in Central American in the early 1980s, a time of tremendous civil unrest and guerrilla warfare in the region. (That's also where I learned to speak Spanish!). Since putting out my shingle in 1995, I have handled literally thousands of cases from clients throughout the world and from many different national and ethnic groups. We have won several groundbreaking decisions, including one involving three Honduran children that helped expand the boundaries of asylum law. I feel very fortunate to have been able to help so many immigrants gain legal status.. Our firm has expanded rapidly over the last 10 years to include four fully staffed offices on Long Island -- in Central Islip, Huntington Station, Riverhead and Hempstead. The vast majority of our attorneys and staff are immigrants or first-generation Americans. While most of our clients are Hispanic, we also represent immigrants from around the world in family-based and employment-based cases.. I and my staff strive to provide the best possible service to our clients at the most reasonable fee.
I am an immigrant from Monterrey Mexico and I know firsthand through my clients' experiences the difficulties of obtaining legal status. We are more than just a law firm, we are your advocate to represent you and do all we can to grant you relief and legal status.
As a partner at Saev Hernandez Immigration Practice, my focus of work includes permanent residence through employment, particularly the labor certification process. I also work on family-based immigration and humanitarian cases, such as U visas, waivers, deferred action for childhood arrivals, and special paths to citizenship. I speak and write on topics including the immigration regulatory environment in Tennessee, immigration options for children, citizenship, and comprehensive immigration reform. I volunteer for the Tennessee Immigrant and Refugee Rights Coalition (TIRRC) as the supervising attorney for its Welcoming Tennessee Naturalization Clinics. I am fluent in Spanish and speak the language at home. My husband is an immigrant from Mexico and we have personally gone through the permanent residence process, including a provisional waiver application and consular processing. In part due to my own experience, I offer thorough and thoughtful advice to families facing possible separation due to the immigration system. I became an immigrant advocate in 1999-2000 while working as an AmeriCorps*VISTA volunteer at the Political Asylum Project of Austin. I first pursued the job because it offered me the chance to practice Spanish at work, but quickly found myself immersed in the foreign language that is immigration jargon. I supported volunteers in a clinic setting and gave human rights presentations to immigrants on the San Antonio immigration court detained docket. I then worked as an immigration paralegal in Austin, Texas for several years and applied for law school knowing immigration practice had me hooked. Following law school, I practiced law as an attorney at Rose Immigration Law Firm for seven years.
Mr. McGinty has had a few distinguished careers prior to becoming an attorney. He joined the US Navy after high school. He got through one of the toughest schools in the military, and became a Helicopter Rescue Swimmer. He was stationed in Japan and traveled all over the world.. After serving his country he put himself through college. He worked full-time while going to school full-time. He graduated cum laude with a bachelors degree in finance.. He then joined IBM where he became a Forensic Financial Analyst. Within 3 years he was managing over 30 analysts, and helped some of IBM’s largest clients become more efficient and profitable.. However, the boyhood dream of becoming a lawyer never left him. He decided to make his dream a reality. His first clients came by way of a Child Advocacy Clinic in LawSchool where he represented children in foster care. He found that he had limitless energy and zeal when it came to fighting for his client's rights. It was then that he knew he had made the right life choice, and his final career change.. Today, he has chosen areas of the law that make people's lives better. In representing people who have been victims of investment fraud, he has found a way to get his client's hard-earned money back. With Immigration, he has literally changed the course of his client's lives; he had the privilege of representing a client from the Darfur region of Sudan who was seeking asylum from the horrible genocide taking place there. In representing parents who have had their children placed in foster care, he not only advocates on their behalf legally, he helps them personally to change the circumstances that led to their children being removed from their care; there are dozens of reunited families in NJ who spent Christmas morning together because of his advocacy. Being of service to his clients gives his life passion and purpose. It's not a job for Mr. McGinty, it's a calling.
