My practice focuses on all aspects of civil litigation defense from subrogation matters to workers' compensation cases.

Mr. Irwin specializes in employment, liability defense, subrogation, and workers’ compensation litigation.  He has invaluable litigation experience in prosecuting and defending hundreds of bench and jury trials before state and federal courts and administrative agencies.  He takes seriously the role of counselor – helping companies formulate sound preventative measures to avoid disputes prior to their inception.  However, when litigation is appropriate, he believes in an aggressive team-oriented approach combined with the experience necessary to bring about a successful conclusion.. Mr. Irwin is a native of Colorado Springs, Colorado.  He began his litigation practice with the City of Colorado Springs, providing counsel to all City departments including airport, fire, hospitals, human resources, police and the largest four-service municipality owned utility in the nation.  He was the City’s primary litigator in employment, subrogation, and workers’ compensation matters.  In 2007 he was recruited to Ritsema & Lyon, P.C., specializing in workers’ compensation, subrogation and general insurance defense litigation.  In 2009 he formed Irwin, P.C., a law firm specializing in all aspects of employer needs, including employment law advisement and litigation, subrogation, and workers’ compensation.  Wanting to provide his clients with the advantages of a top tier full service law firm, Mr. Irwin joined Pollart Miller LLC in 2012.

Ms. Benson joined Pollart Miller in 2012 and focuses her practice on insurance defense litigation, including representing companies and insurance carriers in workers’ compensation and liability matters, and criminal defense.. During law school Ms. Benson served as the Editor-in-Chief of the Barry Law Review where she was responsible for the publication of two law review journals, as well as hosting a live symposium. Ms. Benson also interned with a Fortune 500 company, served as a research assistant, and became a Certified Legal Intern in Barry University’s Children and Families Clinic where she represented juveniles charged with criminal offenses.. Upon graduating from law school, Ms. Benson gained significant trial experience by serving as a prosecutor in Volusia County, Florida. During her time with the State Attorney’s Office, Ms. Benson sat first and second chair on numerous jury trials, bench trials, and violation of probation hearings, as well as successfully argued countless motions and other pre-trial matters.. Ms. Benson left the State Attorney’s Office in 2010 to focus her practice solely on civil litigation. Ms. Benson practiced with a personal injury law firm in Orlando, Florida where she represented injured clients in medical malpractice, premises liability, nursing home neglect, auto accidents and other personal injury actions. Ms. Benson’s experience in representing plaintiffs provided a unique perspective into both the motives and drivers of her clients. Utilizing this knowledge, Ms. Benson then joined an insurance defense law firm in Central Florida and represented insurance carriers and their insureds in the defense of civil liability claims. In 2012, Ms. Benson relocated to Colorado where she continues to focus her practice on defending insurance carriers and their insureds in civil litigation and workers’ compensation matters.

KRISTIN A. CARUSO holds a B.S. from Cornell University’s School of Hotel Administration, an M.B.A. from the University of Denver, and a J.D. from the University of Denver, where she served as an editor of the Denver Journal of International Law and Policy. She is also a Medicare Set-Aside Consultant, Certified.  Ms. Caruso is admitted to practice in the State of Colorado as well as the United States District Court for Colorado. She practices litigation in the area of general civil litigation, including workers' compensation defense with a specific focus on high profile cases including professional sports. Tiffany Scully Kinder graduated from the University of Virginia in 1994 with a B.A. in Foreign Affairs. While at UVA, she spent a semester abroad studying at the University of Salzburg. From Virginia, she traveled to Denver, Colorado, where she attended the University of Denver, Sturm College of Law and graduated in 1997.  That same year, Ms. Kinder became a licensed attorney in the State of Colorado.   Ms. Kinder began her career representing insurance carriers and employers in the areas of insurance subrogation and general liability.  By 2001, she focused her career on the defense and representation of employers and insurers in workers’ compensation claims and subrogation cases.  Ms. Kinder has extensive experience with Medicare Set Asides and subrogation recovery. Ms. Kinder has appeared on behalf of clients state-wide in State, County, and District Courts, as well as in all Office of Administrative Court forums.  She has also argued before the Colorado Court of Appeals. Ms. Kinder is a member of the following professional organizations: Women’s Business Enterprise National Council; National Association of Professional Women; Colorado Women’s Chamber of Commerce; Defense Research Institute; Colorado Defense Lawyers Association; Denver Bar Association; Colorado Bar Association; and the CBA/DBA Professionalism Committee.   Ms. Kinder has represented, and continues to represent numerous Fortune 500 and Fortune 1000 companies.  Ms. Kinder’s philosophy in handling cases on behalf of her clients may be summarized as follows: aggressive representation and protection of her clients’ interests, with a goal of bringing all cases to resolution in the most cost-effective and expeditious manner possible.  Every case must be analyzed and handled on its own merits.  Some cases will move quickly towards settlement.  Other cases may require more intensive litigation through the appellate level.  However, it is the client who drives the case, and it is the attorney’s responsibility to be responsive to the needs of the client.  It is this philosophy that has allowed Ms. Kinder to develop meaningful and long-standing relationships with her clients.

Stephen Abbott is a graduate of the University of Colorado Law School and Wabash College, where he graduated with distinction.. Before beginning his legal career, Stephen taught English to elementary, high school, and university students in Mexico City where he sharpened his public speaking skills.  After law school, Stephen worked as a law fellow at the City Attorney’s Office in Denver, defending the municipal employer in workers’ compensation actions, and developing the skills he would later take to Lee & Brown.. Stephen has joined the City and County of Denver as an Assitant District Attorney in Workers' Comensation..
