I am an attorney and parnter at ELPO who works primarily on products liability and personal injury cases, with most of my practice focusing on defective medical products and pharmaceuticals.. I am handling lawsuits against the makers of IVC (inferior vena cava) filters, which are used to prevent blood clots from traveling through the body and causing a pulmonary embolism. The IVC filters are sometimes left in the body for too long, and can puncture veins and cause other severe problems. I am also representing patients who have been injured by Bair Hugger Forced Air Warming Blankets. The blankets are used during surgery to keep patients warm, but can promote deep joint infections after orthopedic surgery. These infections can sometimes lead to painful revision surgeries or amputations.. Beyond medical devices, I am handling cases involving Actos, a diabetes drug that has been linked to bladder cancer, and Lipitor, a drug taken to lower cholesterol that has been shown to cause diabetes in post-menopausal women. I am also representing patients who have suffered severe bleeding events while taking the Xarelto, a popular drug used to treat atrial fibrillation and deep vein thrombosis. I also represent patients injured by the Fluroquinolone antibiotics Levaquin and Avelox, which can cause peripheral neuropathy, and I am fighting for the rights of children born with birth defects because their mothers took Zofran during their first trimester of pregnancy.. I have an undergraduate degree in accounting from Western Kentucky University and a law degree from the University of Kentucky. I am a member of the American Association for Justice, the Kentucky Justice Association, the American, Kentucky and Bowling Green-Warren County bar associations. I recently graduated from the Leadership Bowling Green program, am serving on the Western Kentucky University Young Alumni Council and the Board of Directors of the American Red Cross of South Central Kentucky and the Bowling Green-Warren County Bar Association. Firm: Yussman Special Needs Law & Wyatt Estate Planning
6500 Glenridge Park Place , Louisville , Kentucky 40222
Practice Areas: Estate Planning
I have been practicing in the estate planning area since 1982. I have an undergraduate degree in accounting, so I have always been interested in the tax planning aspects of estate planning, as well as working with individuals. I have worked in virtually all phases of estate planning, including the preparation of comperehensive (and often complex) estate plans, including working with owners of closely held businesses, nonprofit organizations, professionals, and a great variety of interesting people. Each family situation presents unique opportunities (and often challenges) and I try to approach each client as if they were a member of my own family.. With the birth (adoption) of my two special needs children in the early 1990's, I became very interested in planning for special needs children. This work has enabled me to not only help my clients, but to also learn from them! Together we work to solve the individual special needs planning situation in order to maximize total resources available to the special needs individual. This includes maximimizing government benefits such as Social Security and Medicaid, arranging appropriate Trustee and advisory roles, identifying service-providers who may be able to help the individual in his or her special situation, providing for maximum flexibility for unforseen circumstances, etc. I prepare estate plans for clients with special needs loved ones (so called "third party" special needs trusts), as well "first party" special needs trusts for disabled individuals who may have received an unplanned inheritance, a lawuit settlement, etc. Without the use of a special needs trust, the disabled person may lose his or her benefits and we can avoid that outcome in the vast majority of cases.. My practice if very personalized and has brought me great personal and professional satisfaction for well over 30 years.

I'm passionately interested in employment law because it is so much broader than just contracts and production. It's a diverse subject of paperwork and personalities, and the many ways that those can go so very wrong or so very right. For that reason, I am passionate about impacting the employer-employee relationship-- a relationship that I believe to be among the most important relationships a person or entity can maintain.. Prior to becoming a licensed attorney, I completed labor and employment clerkships in Cincinnati, Northern Kentucky, and Lexington.
