Derek Loeser is a senior member of Keller Rohrback’s nationally recognized Complex Litigation Group and a member of the firm’s Executive Committee. He maintains a national practice prosecuting class action and large-scale individual cases, including corporate fraud and misconduct, securities, Employee Retirement Income Security Act (“ERISA”) pension and health plan, breach of fiduciary duty, and investment mismanagement cases. Derek has served as lead and co-lead counsel in large, complex cases in state and federal courts around the country.. Derek has been a plaintiffs’ attorney for over 20 years. He has a passion for taking on large corporations and holding them accountable for wrongdoing. Through all stages of litigation, including trial, he has helped recover billions of dollars for consumers, employees, retirees, retirement plans and institutions. Notable cases include the Wells Fargo unauthorized account consumer class action, for which he serves as lead counsel. Derek and the Keller Rohrback team achieved a $142 million settlement that requires Wells Fargo to refund all improper fees, and provide first-of-its kind credit damage reimbursement, among other relief, to Wells Fargo customers. Other notable cases include mortgage-backed securities cases on behalf of the Federal Home Loan Banks of Chicago, Indianapolis and Boston; ERISA class cases on behalf of employees of Enron, WorldCom, Countrywide, and Washington Mutual, among others, whose retirement savings were decimated by corporate fraud and abuse; fraud, RICO, and antitrust cases against drug manufacturers, pharmacy benefit managers and insurance companies for conspiring to drive up the cost of life-saving medications, such as insulin and epinephrine (EpiPens).. Derek also represents state and local government entities in a number of matters, including ongoing cases against opioid manufacturers for misrepresenting the safety and efficacy of opioids for chronic pain.
