Yan spent her childhood both in a metro city of Shanghai, China, and a suburb city of Hiroshima prefecture in Japan. Her immigration to Japan from China taught her respect to other cultures, critical and independent thinking, and struggles in surviving as a foreigner in an unfamiliar land. After graduating high school in Japan, Yan came to the U.S. to further explore the world. She was fascinated by the diversity, though she soon realized the same struggles foreigners in the U.S. had as those of her childhood - culture, language, social status, and immigration status. She then determined to be an immigration lawyer and utilize her experiences and skills to help those who strive to make a successful living in the new land of the U.S.After graduating from University of California, Los Angeles in 2009, Yan interned at Tomita Law Office for a year, where she reaffirmed her passion to work with immigrants and nonimmigrant workers. Thereafter, she enrolled in Santa Clara University School of Law and participated in its famous immigration clinic at Katharine & George Alexander Community Law Center, working on various humanitarian immigration cases, including U visas and T visas. She also took on an asylum case as part of a class, submitting briefs to the United States Court of Appeals for the Ninth Circuit, and negotiating for prosecutorial discretion with the U.S. Immigration and Customs Enforcement. Upon graduation from Santa Clara University in 2013, Yan rejoined Tomita Law Office to pursue her dream of making life easier for those who strive to make a successful living in this country of possibility and hope.

I am an immigration attorney with over nine (9) years of experience in immigration law. I have devoted my legal career to meeting the immigration needs of both individuals and businesses. I am currently working as a Senior Attorney at Immigration Law & Visa LLP. For the last five years, I have specialized in assisting individuals of extraordinary ability in the arts, education, business, sciences, and athletics in the filing of O-1 and EB-1 petitions. Through this work, I have helped numerous world renowned musicians, actors, artists, producers, directors, designers, scientists, chefs, business executives, and engineers pursue their professional endeavors in the United States by obtaining nonimmigrant and immigrant employment-based visas. In addition, I have assisted a wide range of corporate clients in obtaining a broad spectrum of immigration benefits on behalf of their foreign national employees. In addition, since the start of my career I have counseled and successfully represented clients in multiple areas of immigration law, including family and employment-based immigrant and nonimmigrant petitions, naturalization, waivers of inadmissibility, as well as asylum, U visa, and VAWA (Violence Against Women Act) applications.. Until early 2014, I worked as Of Counsel for Beach-Oswald Immigration Law Associates, in Washington, D.C., where I had worked as an Associate Attorney from December 2008-January 2013. Prior to becoming an attorney in 2008, I worked as a Law Clerk in the immigration field for two years. In total, I have worked in the immigration field for roughly 11 years.. I am admitted to practice law in the State of Maryland, but have represented clients throughout the United States with their immigration issues. Working in a small law firm for roughly 6 years allowed me to gain valuable immigration litigation experience. This experience allows me to successfully represent clients before U.S. Citizenship & Immigration Services, the U.S. Immigration Courts, the Board of Immigration Appeals, and Federal Courts throughout the country.. I work on a variety of immigration matters. I have assisted both corporations and individuals around the world, acquiring nonimmigrant and immigrant visas through employment, family. and asylum. I have significant experience in employment-based visas for individuals of extraordinary ability in the arts, sciences, athletics, and business sectors. Moreover, I have over 6 years of experience handling removal defense cases before the U.S. immigration Courts involving asylum, hardship waivers, and cancellation of removal. I have extensive experience in writing appeals and motions to reopen or reconsider before the Board of Immigration Appeals and Federals Courts. Finally, I also have experience working with the federal district courts in civil cases involving writs of mandamus, seeking to compel government agencies, such as USCIS, to perform their duty to adjudicate immigration petitions and applications.
I am a reasonable fee/low-bono community immigration attorney. My main office is in San Rafael and I share my time between this and my two outpost offices, in Oakland (2 mins from Amtrak Jack London Square) and in Palo Alto - on S. California.. I am also the immigration attorney for a local nonprofit - the Brazilian keep my private fees low - the same as the non-profit - since i can't compete with myself. And because I get all the nice clients that way.. I limit immigration court work to asylum cases and children, so I don't compete directly with my wonderful colleagues dedicated to removal defense.. Come see me for the smallest form, green cards, naturalization through to a U-Visa or VAWA application, or anything to do with minors or dreamers with immigration issues,. Or just for a consultation to talk over your immigration issues and options. Also, if you are here through the employment route, your lawyers represent your employer, and you might find it helpful to discuss questions with an independent attorney. Particularly one with a long career in business before becoming an attorney.
