Josh Lewin represents both businesses and individuals in a variety of civil litigation matters. His extensive experience includes complex business disputes, breach of contract and unfair competition litigation, catastrophic injury and death claims, discrimination suits, insurance coverage disputes, as well as property and environmental claims. Josh also has extensive experience in the utility and energy industries, having represented the largest regional telecommunications, natural gas and electricity providers. Josh has handled lawsuits from inception through trial and appeal in both the state and federal courts. In 2009, Josh successfully defended consumer claims in the federal district court under the federal Fair Credit Reporting Act and Fair Debt Collection Practices Act and prevailed on appeal before the United States Court of Appeals for the First Circuit in a case which decided several issues of first impression. See Chiang v. Verizon New England Inc., 595 F. 3d 26 (First Cir. 2010). In 2013, the Massachusetts Appeals Court upheld a Superior Court jury's verdict in favor of Josh's clients against their former attorney for charging an unfair and excessive fee and affirmed the trial Judge's award of triple damages and attorney's fees under the Consumer Protection Act, commonly known as chapter 93A. See Landry v.  Haartz, 83 Mass. App. Ct. 1135 (2013). In addition to his regular civil caseload, in March 2009, Josh was sworn in as a special assistant district attorney for Suffolk County. In that capacity, he prosecuted white collar criminal cases for the Special Prosecutions Bureau on a pro bono basis.

I have developed my practice over the past three decades, focusing primarily on bankruptcy and insolvency proceedings. I often represent individuals and small businesses, secured and unsecured creditors, committees of creditors, trustees and equity security holders in bankruptcy and insolvency proceedings as well as financial institutions and other lenders in out-of-court loan restructurings, assignments for the benefit of creditors, foreclosures, repossessions, and the sale of distressed assets and businesses. I also have experience representing business debtors in workout, restructuring and bankruptcy matters.. I have extensive experience in all facets of cross border insolvencies and cross border insolvency litigation. I am regularly engaged by private equity firms, governmental agencies and estate representatives to advise and counsel them on a wide range of cross border insolvency issues, with particular emphasis on United States/Western Europe jurisdictions.. Over the years I have cultivated extensive knowledge and skill in commercial and complex business litigation including veil piercings, corporate officer and director liability, successor liability, fraudulent conveyance and transfer litigation and constructive trust litigation. I have experience counseling clients on distressed M&A transactions, corporate governance issues and complex business restructurings. I also have significant experience representing financial institutions in workouts and foreclosures of aircraft and related international equipment and have repossessed aircrafts in various states throughout the United States.

Attorney Comenzo is a distinguished litigator and oral advocate. In law school, he won trial advocacy, appellate advocacy, and negotiation competitions. He earned the award for the Best Advocate in New England in the regional round of the 2006 American College of Trial Lawyers’ National Trial Competition. Following law school, Attorney Comenzo spent several years at a boutique civil litigation firm in Boston handling complex civil litigation matters and product liability cases. Later, he transitioned to a solo practice where he focused on criminal defense. During this time, Attorney Comenzo had the privilege of working with esteemed criminal defense attorney, Marty Leppo.
