EDUCATION: I am from the Upper Cumberland Area and went to Law School in Nashville.  I worked my way through college at Tennessee Tech, and then through Law School at the Nashville School of Law, graduating in 1983.. OFFICES:  I first opened my office in Monterey in August 1984 until July 1988, when I moved to Cookeville.  My office was on the square for many years, but I purchased my own building in August 2011, located at 101 S. Jefferson Ave, Cookeville, Tennessee.   I share office space with three other very good lawyers, and can refer you in-house, if necessary.  I have two paralegals with many years of experience who work for me.. I handle cases in Putnam mainly, but also go to White, Overton, and Jackson counties, but the other attorneys in the office go to several other counties.. FAMILY AND DOMESTIC RELATIONS CASES: I have a number domestic relations cases, including but not limited to divorces, with and without children, divorce with large amounts of property and others where the parties were married for a long time and the court awarded alimony.  I have had to appeal some cases along the way.  I tried one relocation case, and the court denied the relocation, but on appeal the trial court was reversed.   I, after winning a relocation case allowing my client to move with her child to Italy, defended an appeal  of that case and the appellate court upheld the trial court.  I have tried a number of termination cases, several have been appealed.. I have worked on child support, child custody, paternity, parentage, divorces with or without children, terminations of parental rights, adoptions, relocations case and more.. CRIMINAL PRACTICE: I practiced more criminal law when I first started practicing law.  I have handled more than five first degree murder cases, and several death penalties.  I tried one death penalty case, and appealed it all the way to the U.S. Supreme Court. I had one murder case dismissed on motion. and not appealed by the State.  I had one first degree murder reduced to reckless homicide, after hearing a motion regarding his confession.  My most recent murder case was in 2012, my client was convicted of manslaughter.. I have appealed a number of criminal cases, some regarding search and seizure, confessions and sentencing.. MEDIATION: I am a Rule 31 mediator, with domestic violence certification.  I don't handle as many mediation as I would like, but enjoy that part of my practice, as well.. I practice in the Upper Cumberland region of Middle Tennessee; primarily in Putnam County.  After moving with my family to the area in the late 90's, I chose to attend Tennessee Technological University.  While there, I earned a Bachelor's Degree in Civil Engineering.  Afterwards, I attended The Appalachian School of Law in Grundy, Virginia.  Located in the valleys of the Appalachians, ASL is a nationally acredited, private law school that specializes in Natural Resources Law.  I then moved to Nashville to study for the Tennessee Bar Exam.  After passing the Bar, I returned to Cookeville where I currently live with my wife, Courtney, who is a nurse at Cookeville Regional.. Primarily, I practice in the areas of criminal defense, bankruptcy, domestic relations, and civil litigation.. Gordon Allen Byars was born in Las Vegas but moved to Huntingdon, a small town in West Tennessee, when he was in seventh grade and has remained in Tennessee ever since. Mr. Byars earned his Bachelor's degree in Sociology with a concentration in Criminal Justice from Tennessee Technological University in Cookeville Tennessee.. Mr. Byars earned his Doctorate of Jurisprudence from Lincoln Memorial University. While in law school Mr. Byars served as a law clerk for the Tennessee Attorney General and Reporter in Nashville and was selected as a research assistant by the faculty at Lincoln Memorial University. Mr. Byars received the General Oliver O. Howard Pro Bono Award for rendering nearly 200 hours of meaningful pro bono service to those in need while he attended law school.. A 1987 Graduate of Livingston Academy, David was the Distinguished Honor Graduate for the US Army Signal Training Center in Fort Gordon, Georgia before returning home to attend Tennessee Technological University. There he received an AS in Criminal Justice (1992) and BS in Sociology (1994). Later, David attended the Nashville School of Law and received his Doctor of Jurisprudence in 2008 and passed the Tennessee Bar Exam in 2008.. After serving over two decades as a Probation Officer working dozens of Courts across Tennessee at every level David chose to retire from probation services. After being appointed by Governor Bill Haslam in 2016, David continues to serve on the Private Probation Services Council and was recognized for his expertise in probation.. David was also a member of the Livingston Jaycees and held various offices including President. He was a member of the Board of Directors for Teen Challenge of the Upper Cumberland, a Graduate of Leadership Overton (2002), serves in Emmaus of the Cumberlands, as well as Central City Church.. David has lived all of his adult life in Overton County Tennessee where he retired honorably after twenty years of service with the Livingston unit of the Tennessee Army National guard, including over seventy-five combat missions in Iraq. David was admitted to practice law in the State of Tennessee in 2008 and in the United States District Court for the Middle District of Tennessee 2018.
