In 1994, I began to work in Long Term Care. I know most of the owners and operators of Skilled Nursing and Assisted Living facilities in Northern California and the Central Valley. I understand concerns that residents face:. As an Estate Planning attorney, I work with families to find solutions to these questions. I know loving family members share these stresses. Spouses, primarily wives, do all they can to keep their dear husbands at home. This is tireless work. These women are primary caregivers for their husbands in failing health. Daughters too provide much support for frail parents.. My career in Long Term Care showed me the best characteristics of The Greatest Generation. I am thankful for their example of work and service.. I love my clients. I love meeting with them. Their stories, interesting dynamics, and concerns drive me. I want client challenges to me my challenges; their worries my worries and want to see their victories. I always approach clients with the intent to preserve family peace and harmony.. I thoroughly enjoy what I do.. The stunning Mrs. MacFarlane and I will celebrate 15 years January 2011. We have three children: 3, 8, and 10. Working full-time, and with the support of my dear wife, I started law school in 2004. I graduated and passed the bar in the summer of 2008, and was admitted to practice law January of 2009. Since admission to the California Bar, I continue to work and build my Estate Planning practice. My clients range from newly married, to young families, to those deep into retirement and facing more severe health issues.. I am grateful for the trust clients bestow in me.
I have represented clients in bankruptcies for over 30 years, primarily in consumer cases (Debtor chapter 7 and 13s) I worked for a chapter 11 Trustee in the late 1980s and early 90s as he tried to wrap up a chapter 11 derived from a ponzi scheme, where I realized many people are far too trusting of a smiling face and a good (if implausable) story. I try to make sure my clients are clear, not only of their options, but also how their prior activities gave rise to those options. If there are issues that may cause difficulties, I will also give guidance in minimizing the risk to you. If creditors object to something in the filing by filing objections to the discharge of their debts (not a common occurance), I can also represent you with regard to those objections.. Since opening my own office, I have represented consumer and business clients in chapter 7 and 13 as well as chapter 11s, where appropriate. I believe bankruptcy should not be a first option for dealing with debts, and will tell you if a bankruptcy can be reasonably avoided, such as if you have no unprotectable assets and income, but creditors calling for payment.. The office added a furry receptionist to the staff in 2001, and we have had a dog to greet guests since then. Mollie is the pretty black and white border collie who will greet you at the door. Her side job is squirrel security, so don't be surprised,if you visit the office you see her darting from office to office while she surveilles the wiley rodents. (Pictured with me on our advertisements is Tucker, also a border collie mix. He was also an enthusiastic receptionist but passed away in 2014.)
I attended Sac State and received my law degree from Lincoln Law School which I paid for by working as a Correctional Officer at Mule Creek State Prison. I also worked for the Franchise Tax Board and passed the bar exam in 1998 while there. I went into private practice in 2002 with my primary focus being family law. I have successfully defended several decisions on appeal with the most recent being published on request of a domestic violence organization. Being a victim of domestic violence myself, I am a very strong advocate for clients and their children who have or are suffering abuse at the hands of another.. I enjoy local travel to ghost and gold mining towns in the Sierra's, both California and Nevada and also enjoy the occasional stop at some of the local winery's found in the Sierra foothills. I am also a huge fan of our beautiful California coastline and travel to favorite destinations up and down through coastal city's and communities any chance I get. I am married with two wonderful children and a loving husband to share my life with.
I am a hometown attorney that handles Estate Planning, Wills, Trusts, and Medi-Cal planning focusing on the needs of elders as well as Special Needs Trusts for those with disabilities. I also handle Probate matters, decedent's estates, and trust administration.
