I was born in the mountains outside of Wolf Creek in rural Josephine County.  I grew up in Ashland and am a proud graduate of Ashland Middle School and Ashland High School.. I was born in Portland, Oregon, but grew up in Scottsdale, Arizona. I returned to Oregon for college and law school, and have lived in Portland for over 10 years. During that time I have dedicated my time to working to improve our community and criminal justice system. I have worked at the Federal Public Defenders, the Multnomah Courthouse, and Metropolitan Public Defenders. I started riding motorcycles in 1985.  I started practicing law in 1997.  I eventually became a motorcycle attorney.  I help fellow riders who are injured in Oregon and Washington and work on motorcycle-related legislative issues in Salem and Olympia.  I am passionate about all things motorcycle.

I started practicing law in 1992.  I opened up my own practice immediately after graduating from law school and passing the bar exam.  For the first two years I mostly did criminal defense.  Then I started representing criminal defendants in civil matters:  they had been held in jail too long, or beaten by the police.  Then I began to represent people outside of the criminal law system injured in accidents  -- primarily car accidents.. I liked doing that sort of work (personal injury or "PI" work).  It tends to be less contentious and less stressful than some other areas, although no area of litigation is without its stressors, as conflict is inherent in the process.. When I cannot agree with the other side -- which is often, I am afraid -- I like to adhere to two concepts.  The first is to disagree without being disagreeable.  The second is to agree to disagree:  stop trying to convince the other side that I am right and get the case before a judge or arbitrator to settle the matter.

I started my career as a paralegal for a civil litigation firm before dedicating myself to family law in law school. Originally I began my career as an attorney in San Diego County before moving to Oregon and joining a family law firm in 2012. I began my own solo practice, Brincat Family Law, in 2016, serving Oregon and California clients. I start with the presumption that there is a favorable solution to a client's legal problems, and hold to that presumption until I am convinced, beyond any reasonable doubt, that there is no feasible remedy.. My passion is for any area of the law relating to land, whether it be zoning, municipal, environmental, real estate, easement, adverse possession, or boundary law.   People's identities are often deeply rooted in where they live, how they use their land, and how others respect their rights.  The right to protect one's land against trespassers, to curb inappropriate nearby development, or to gain  relief from senseless government restrictions is one of the few values in society that is really worth fighting for.. Much of the time it is possible to reach a win-win settlement of a land or zoning dispute.  However, when that is not possible, it is essential to hire an attorney who deeply understands the intricacies of these areas of the law.  Land law is combination of the very ancient and the very modern, with all sorts of intricate procedures mixed in.  It is fascinating but complicated.. There are times when I wish I were younger -- who wants to get old?  However,  experience has its advantages.   After practicing law for 32 years, there is very little I have not seen, and few places I have not been. Nothing surprises me much.  That does not mean that I'm stuck in my ways.  The more you know, the more you realize how much there is left to be discovered.  Leave no stone unturned.. I work with people from all walks of life.  I have dealt with officials, agencies, and bureaucrats from the smallest towns in Maine to Washington DC.   Although lawsuits and administrative appeals are too costly to be started without careful thought, if they cannot be avoided, I enjoy a good fight.  Nothing is more satisfying than seeing the relief on a client's face when I have thrown down the last obstacle standing in their way.. I am lucky.  I love what I do. I welcome all the possibilities and challenges that arrive with each new case.. No attorney can fix every problem.  However, there is no attorney who will try harder than me to find you a way out of your predicament, or a means to achieve your goal.. Although it is foolish to tilt at windmills, the fact remains that you have to believe there's a solution if you are ever going to make it happen.  Realism is good.  Pessimism is not.

I have conducted both trial and appellate litigation in federal and state tribunals across the country, including the Second and Ninth Circuit Courts of Appeals, Eastern District of New York, New York and Oregon state trial courts, and Virginia State Corporation Commission. I regularly handle matters involving federal and state environmental and natural resource agencies, including EPA, BLM, USFWS, Oregon DEQ, and the Washington Department of Ecology. I have assisted with the environmental review and compliance aspects of numerous corporate transactions. I earned my J.D. from Columbia University School of Law, where I was a Stone Scholar, and served as Editor-in-Chief of the Columbia Journal of Environmental Law.
