M. Eric Olmstead's practice focuses in the areas of Employment Law, Construction Law, Business Law, and Real Estate Law. He handles cases involving wrongful termination, sexual harassment and other Title VII-based claims, ADA, non-compete agreements and trade secrets. He also counsels and trains employers on how to minimize their exposure to the risks of employment lawsuits. He works with owners, contractors, subcontractors and suppliers in all phases of the construction process, including contract formation, bonding, liens, claims and litigation relating to these areas. Eric represents existing businesses in their legal needs, including contract drafting and enforcement, UCC, dissolutions and collections, and assists clients in forming and operating new businesses, including Local and small corporations. He represents buyers and sellers in commercial and residential real estate purchases and litigation arising from such transactions. He also represents developers in all phases of real estate development, including drafting development agreements, financing, representation before city and county planning officials and litigation related to these areas.. Eric has lectured on employment law, labor relations and construction law topics for private groups, trade organizations, the Utah Department of Workforce Services and the Utah State Bar. Prior to joining Barney McKenna & Olmstead, he practiced with respected law firms in St. George and the San Francisco Bay area.. Eric has been an active member of the St. George Area Chamber of Commerce since moving to St. George, Utah. He is the past legal counsel for the Chamber and has served on its Community Action Committee and Member Relations Committee. Eric is member of the Rotary Club of Dixie Sunrise. Eli Milne’s practice focuses primarily on commercial litigation and appeals, especially in the construction, real estate, and business contexts. His experience includes representing providers and purchasers of construction services and materials in matters involving construction defects, contracts, and liens; representing buyers, sellers, owners, lessors, and tenants of real estate in land and lease disputes; representing owners, directors, officers, and employees in business and employment disputes; and representing individuals and entities in a broad array of other litigation matters.

Bryan’s practice concentrates primarily on civil and appellate litigation, employment law, and real estate development.. Litigation. Bryan represents businesses and individuals in a broad spectrum of litigation matters—from commercial contract disputes to land use claims.  His litigation practice primarily consists of defense work, with an emphasis on defending governmental entities in constitutional, civil rights (42 U.S.C. § 1983), employment, personal injury, and land use matters.  To that end, he has extensive experience with issues involving Utah’s Governmental Immunity Act, as well as state and federal constitutional matters.  Although he works out of the firm’s St. George office, Bryan regularly handles cases throughout the State of Utah.. Appellate.  Bryan has briefed and argued numerous cases before Utah’s appellate courts.  He is frequently retained to handle the appeal in cases handled at the trial level by other attorneys, both in and outside the firm.  He has served on the Utah Supreme Court’s Advisory Committee on Rules of Appellate Procedure since 2003.  Additionally, he has both written and presented on the topic of persuasive legal writing and appellate advocacy.  Before entering private practice, Bryan was a judicial clerk at the Utah Court of Appeals.  He maintains an AV® Preeminent™ Peer Review Rating in the areas of Litigation and Appellate Practice.. Employment Law.  Bryan’s employment law practice is primarily devoted to representing public and private employers.  His representation includes drafting policies, procedures, and employee handbooks; risk management; defense of wrongful termination, discrimination, harassment, and similar claims; wage and hour issues; and assistance on internal investigations.  He has twice been named as a “Rising Star” in the area of employment law by theMountain States Super Lawyers’ magazine.. Real Estate and Land Use.  Bryan has significant experience handling land use and zoning issues for both governmental and private interests.  He also represents developers in all stages of the development process with a particular emphasis on the creation and establishment of planned communities.  His projects have ranged from small residential condominiums to large master planned golf course communities.

Bruce was inducted into the College of Community Association Lawyers in October 2012. Bruce was the Founding Partner of Jenkins Ronnow Jensen and Bayles in 1997 and continued until 2010, when he became the Managing Partner for Vial Fotheringham SG, LLP. During the years 2006-2008, Bruce was also In-House Council for a developer of properties resort and high-end communities. Bruce has been an expert witness on developer duties in the common interest communities. He began his law career in St. George, Utah as an Associate for the Law Firm of Snow and Jensen, P.C. Prior to that he interned for the Alaska Supreme Court, Justice Burke, as a Judicial/Extern in the Summer of 1990.
