Superb trial lawyer. A landowner has an affirmative duty to maintain common areas in a reasonably safe condition. The duty extends to the removal of snow and ice and is based upon the tenant’s expectation that the premises have been made safe for the tenant’s use. The Court held a Plaintiff may prevail on her negligence claim by showing either actual or constructive notice of the unsafe condition or that the unsafe condition was reasonably foreseeable.

App. 232, 84 P.3d 304 (2004), a successful appellate decision from a declaratory judgment action involving first party coverage and building code upgrade coverage. Mr. Scheer was also trial and appellate counsel in Schutz vs. La Costita III, Inc., 256 Or. Mr. Derrig is a veteran who served in support of Operation Iraqi Freedom and Operation Enduring Freedom. While in the military, he served as a survival, evasion, resistance, and escape specialist and was an airborne parachutist. He had the honor of working with those that were at high risk for capture and showed them how to survive any situation so that they could return with honor.
