In most cases, there should be no contested child custody disputes but the emotions of the parties create and fuel the dispute in most of the cases. Parents often fail to take into consideration the best interests of the children first and foremost. In those cases, child custody mediations can be useful. There should be almost no contested property division, the parties are entitled to one half of the assets and debts of the marriage. However, concealing of assets is very common, refusal to share information is common and a declaration of war takes place almost in every case related to alimony and child support. If there is domestic violence, restraining orders are obtained. If there are violation of orders, contempt proceedings can be filed. However, if both parties are attempting to do what is right, there is no need for Orders to Show Cause and divorces can proceed in a friendly manner. This means substantial savings in attorneys fees. There is so much needless litigation in divorce cases that can be avoided and most of it can be prevented if you lower the animosity and level of emotional distress between the parties. Finally, if you are not happy with your attorney, or are not getting the answers or results you want, you have the right to change attorneys.. In personal injury cases, I have successfully handled severe injury and death cases resulting from auto vs. auto accidents, slip and fall accidents, bicycle accidents, auto vs. train collisions, premises liability disputes and just about all litigation related thereto.
