I am Daniel Mossinghoff and I am proud to be the Criminal Defense Director for Baumgartner Law, LLC. I have been a criminal defense trial attorney for almost all of the years I have been practicing. I am dedicated to protecting the rights of anyone accused of a crime and vindicating those wrongfully charged.. I graduated Magna Cum Laude from Regis University in 1996 and then graduated law school from the University of Colorado in 2000. As a fledging lawyer, I cut my teeth and learned trial work as a district attorney for four years. Fairly quickly, I realized I was not meant to work as a prosecutor and quit. I missed working with people and arguing to protect our Constitutional rights.. Since then, I have been a criminal defense attorney for the last 16 years. I have defended thousands of clients in the areas of DUI defense, juvenile law, domestic violence and major felony cases--including homicide. I have tried over 250 jury trials and countless motions hearings. I have also presented or been published over a half dozen times in multiple areas of criminal defense.. I also now represent citizens in Civil Rights cases with an emphasis on police misconduct and police brutality. This is a specialized area of law which many attorneys do not practice. Baumgartner Law specializes in this area. I find litigating Civil Rights matters is a natural evolution in my practice of criminal defense. Although this is a very challenging area of law, I also believe it has made me a much better attorney who can now focus on offering remedies to people who have suffered from police misconduct instead of only offering a defense.

I first became interested in becoming a lawyer after reading books about noted trial lawyers such as Gerry Spence, Race Horse Haynes and Melvin Belli. I was inspired by their stories to go to law school even though I had already graduated from college and owned a successful business. I sold my business, was admitted to law school and dedicated myself to learning everything I could about being a courtroom lawyer.. I learned that trying a case well is a skill that can’t be learned just from books. It takes a lot of experience in a courtroom to really develop the ability.. I have now been a trial lawyer for over 27 years. My first jury trial took place in 1987-an acquittal on a DUI case. Since that time, I have tried many cases in both State and Federal Courts ranging from murder and drug trafficking down to accusations of stealing a pack of gum from Krogers. Most cases settle without the need for a trial but I believe my clients receive more favorable offers of settlement because Prosecutors know that if an offer is not fair, I will not hesitate to go to trial and that I have the skills and experience to obtain a favorable outcome.
I am a local resident who was educated in the public school system in Las Vegas, Nevada. I was involved in the boy scouts and rode horses at the old Day Dream ranch at Warm Springs and Eastern. I learned to swim at Sunset Park and climbed many local mountains in our valley with the Boy Scouts. My father was a professor at UNLV and my mother worked as a registered nurse at sunrise for 30 years. Las Vegas has provided a vibrant environment for me to thrive as a child.. During my college years at UNLV, I worked as a student worker in the the athletic facilities which included the North gym where coach Tarkanian conducted his daily practices.. As a criminal justice major I participated in a 260 hour internship with the Las Vegas Metropolitan Police Department Southwest Area Command. During this internship I spent 260 hours on the streets with patrol officers.. During my law school education at Gonzaga University, I studied in Vienna, Austria with Supreme Court Justice Scalia. My studies in three different universities in Belgium, France, and Austrian law schools allowed me the opportunity to gain an understanding of the international criminal justice system through various founders of the International Criminal Court in the Hague.. After graduation, I started working with John P. Fadgen. John was an outstanding criminal defense lawyer and a gentleman who everyone respected. First and foremost, John was a trial lawyer who had crafted his cross examination skills over the decades. His subtle cross examination style would impeach witness after witness.. I opened my first law office in 2001, in which I also was appointed to the CJA panel where I have tried four of the most lenghty and complex criminal trials in our District. United States v. Acosta (Hells Angels), United States v. Kahre (Four Month Tax Evasion Trial), United States v. Camez ( Computer Hacking) and United States v. Sellers (Complex Rico Prison Gang Trial). United States v. Bundy et al (Armed Stand-Off with federal agents) Mr Rasmussen represented Peter Santilli a journalist covering the events in real time.. These trials set the tone early in my career on how to properly defend persons charged with serious crimes.. I sit on the Indigent Defense Committee as the State Bar of Nevada representative. We evaluate lawyers to ensure indigent defendants are competently and passionately represented before our courts.. As a civil lawyer, I was accepted into the Multi-million Dollar Forum. This is reserved for trial lawyers who have received multiple verdicts and settlements in excess of one million dollars. I have settled and tried multiple million dollar cases. I have continued a long tradition of representing persons injuried by others negligence and intentional acts.. My firm has served as legal counsel since the birth of the Las Vegas Tribune, a local newspaper. I have defended multiple attempts to restrain the content of the Tribune. My partner and I have defended without a single defeat every attempt to restrain or intimidate the Tribune with frivolous litigation.. We look forward to consulting with prospective clients who expect the highest level of legal representation.
