My client was found Not Guilty on counts of assault with a deadly instrument and discharging a firearm into an occupied dwelling. I tried the case of State v. Brasher before a jury in Shelby County. It was two assistant district attorney's v. me. Witnesses testimony and evidence was full of holes and the police lied through their teeth. I brought this out before the jury and convinced them of the lies.. I have always wondered how the court has authority over an individual and watched the and fought the court "system" for almost 20 years. What the courts are doing is in violation of the Constitution of Alabama, 1901 and the United States Constitution. The courts were set up by "We the People," not we the government. I have begun to use the laws against them by filing motions to dismiss all the victimless crimes. The Constitution of Alabama, 1901 specifically states that it is THE PEOPLE who give authority and jurisdiction to the court for "harm done to the citizen" Here is what the Constitution of Alabama says that clearly explains the power set up by We the People and not the corporate police state that it has become:. The courts have no jurisdiction over persons as no harm was done to another person. The authority given to the courts comes from the person, not the corporation or agents of the corporation.. § 13. Courts to be open; remedies for all injuries; impartiality of justice. That all courts shall be open; and that every person, for any injury done him, in his lands, goods, person, or reputation, shall have a remedy by due process of law; and right and justice shall be administered without sale, denial, or delay. Constitution of Alabama, 1901. The State assumes that they are harmed when no injury has ocurred. This is a. false premis of authority that does not exsist. The police have assumed the power of. control and neither the State of Alabama nor Counties or municipalities or its’. agents can be a complainant as no injury was done to the corporation, its’ lands,. goods, person or reputation. The Defendant is neither an agent nor employee of. the state or county and therefore are not subject to the rules and regulations of the. corporation. It's like McDonalds telling you that you can't eat at Burger King!. § 2. People source of power. That all political power is inherent in the people, and all free governments are founded on their authority, and instituted for their benefit; and that, therefore, they have at all times an inalienable and indefeasible right to change their form of government in such manner as they may deem expedient. Constitution of Alabama, 1901. The only function of government is to protect the citizen in his enjoyment of life, liberty and property and any other function is illegal and subject to liability.. § 35. Objective of government. That the sole object and only legitimate end of government is to protect the citizen in the enjoyment of life, liberty, and property, and when the government assumes other functions it is usurpation (illegal!) and oppression. Constitution of Alabama, 1901. That the employees’ of the state and county corporations, under color of law and without any authority, have conspired to commit fraud against the people and falsely arrest them, imprisoned them causing damages to their person, property and liberty in violation of the Constitution of Alabama, 1901.. The authority of jurisdiction is given by the person harmed, not the corporate bodies. The State and County corporation suffered no harm and cannot prosecute a case in any court without the authority of the person harmed.. § 36. Construction of Declaration of Rights. That this enumeration of certain rights shall not impair or deny others retained by the people; and, to guard against any encroachments on the rights herein retained, we declare that everything in this Declaration of Rights is excepted out of the general powers of government, and shall forever remain inviolate (unchangeble). The circumstances surrounding most arrest and subsequent incarceration violates the peoples rights under the Constitution of Alabama, 1901 and the United States Constitution.
