My practice focuses on all aspects of civil litigation defense from subrogation matters to workers' compensation cases.

Mr. Irwin specializes in employment, liability defense, subrogation, and workers’ compensation litigation.  He has invaluable litigation experience in prosecuting and defending hundreds of bench and jury trials before state and federal courts and administrative agencies.  He takes seriously the role of counselor – helping companies formulate sound preventative measures to avoid disputes prior to their inception.  However, when litigation is appropriate, he believes in an aggressive team-oriented approach combined with the experience necessary to bring about a successful conclusion.. Mr. Irwin is a native of Colorado Springs, Colorado.  He began his litigation practice with the City of Colorado Springs, providing counsel to all City departments including airport, fire, hospitals, human resources, police and the largest four-service municipality owned utility in the nation.  He was the City’s primary litigator in employment, subrogation, and workers’ compensation matters.  In 2007 he was recruited to Ritsema & Lyon, P.C., specializing in workers’ compensation, subrogation and general insurance defense litigation.  In 2009 he formed Irwin, P.C., a law firm specializing in all aspects of employer needs, including employment law advisement and litigation, subrogation, and workers’ compensation.  Wanting to provide his clients with the advantages of a top tier full service law firm, Mr. Irwin joined Pollart Miller LLC in 2012.

Ms. Benson joined Pollart Miller in 2012 and focuses her practice on insurance defense litigation, including representing companies and insurance carriers in workers’ compensation and liability matters, and criminal defense.. During law school Ms. Benson served as the Editor-in-Chief of the Barry Law Review where she was responsible for the publication of two law review journals, as well as hosting a live symposium. Ms. Benson also interned with a Fortune 500 company, served as a research assistant, and became a Certified Legal Intern in Barry University’s Children and Families Clinic where she represented juveniles charged with criminal offenses.. Upon graduating from law school, Ms. Benson gained significant trial experience by serving as a prosecutor in Volusia County, Florida. During her time with the State Attorney’s Office, Ms. Benson sat first and second chair on numerous jury trials, bench trials, and violation of probation hearings, as well as successfully argued countless motions and other pre-trial matters.. Ms. Benson left the State Attorney’s Office in 2010 to focus her practice solely on civil litigation. Ms. Benson practiced with a personal injury law firm in Orlando, Florida where she represented injured clients in medical malpractice, premises liability, nursing home neglect, auto accidents and other personal injury actions. Ms. Benson’s experience in representing plaintiffs provided a unique perspective into both the motives and drivers of her clients. Utilizing this knowledge, Ms. Benson then joined an insurance defense law firm in Central Florida and represented insurance carriers and their insureds in the defense of civil liability claims. In 2012, Ms. Benson relocated to Colorado where she continues to focus her practice on defending insurance carriers and their insureds in civil litigation and workers’ compensation matters.

It’s important to me to be able to understand and translate complex legal information and legal analysis into clear findings, explanations, and reports for technical and non-technical audiences.

KRISTIN A. CARUSO holds a B.S. from Cornell University’s School of Hotel Administration, an M.B.A. from the University of Denver, and a J.D. from the University of Denver, where she served as an editor of the Denver Journal of International Law and Policy. She is also a Medicare Set-Aside Consultant, Certified.  Ms. Caruso is admitted to practice in the State of Colorado as well as the United States District Court for Colorado. She practices litigation in the area of general civil litigation, including workers' compensation defense with a specific focus on high profile cases including professional sports. There is no issue or claim in Workers’ Compensation law or procedure that Ms. Caruso has not analyzed for employers and their insurers.  From risk management counseling to defense of claims to appeals, her practice covers all aspects, including: Employers/Insurers on Workers’ Compensation Claims, Administrative Penalties, Bad Faith Claims, Arbitration, Mediation, Settlement, Appeals, Subrogation, Complex Case Analysis and Evaluation, Remedial Writs, Exclusivity of Remedy, Specialized Services, Medicare Secondary Payer Act and Complex Structured Settlements, Conditional Payments and Appeals, and legislation.  She has litigated countless workers’ compensation cases for various insurance companies and large self insured companies, and argued appellate issues in all of Colorado's appellate courts.
