Understanding Personal Injury Law

Personal injury law allows individuals who have been harmed because of another person's negligence to seek financial compensation. These cases arise when a person or business fails to act with reasonable care and another person suffers injury as a result. Personal injury attorneys represent accident victims and help them recover damages for medical bills lost wages and pain and suffering.

In the United States personal injury claims are governed by state tort law. Victims may pursue compensation through insurance claims or civil lawsuits. Lawyers investigate accidents gather medical records interview witnesses and negotiate with insurance companies. Because insurers often attempt to minimize payouts, legal representation can significantly improve the chances of obtaining fair compensation.

Serious injuries may lead to long term medical treatment disability or permanent changes in lifestyle. Lawyers help ensure compensation accounts for current and future medical costs rehabilitation and lost earning capacity.

Common Personal Injury Cases

  • Car and truck accidents
  • Slip and fall incidents
  • Workplace injuries
  • Defective products
  • Dog bites
  • Medical malpractice

Each type of case requires evidence such as accident reports photographs medical records and expert testimony.

When You Should Contact a Personal Injury Lawyer

Victims should consider contacting a lawyer when injuries require medical treatment or when insurance companies dispute liability. Legal advice is especially important when injuries cause long term disability or significant financial loss.

How the Legal Process Works

  1. Initial consultation and case evaluation
  2. Investigation and evidence gathering

I provide a unique advantage to my clients. I spent the earlier part of his career as an insurance defense attorney. That experience gives me intimate knowledge of the defense tactics routinely used by insurance companies that I will use to your benefit. This invaluable insight into insurance company thinking and strategy will give you the best possible chance of recovering the compensation you deserve.. I received excellent legal training working for one of Oregon’s most well respected law firms. It became clear to me as my career progressed, however, that I was truly passionate about representing individuals – not insurance companies. It was that passion that led me to found Gamboa Law Firm.

I devote my practice to helping injured people and their familes with their personal injury or wrongful death claims. During my career I have successfully represented hundreds of victims in their claims against insurance companies or wrongdoers. I put my clients first and believe my representation should provide three primary benefits: 1) navigating the complicated and confusing world of insurance claims on your behalf; 2) placing you in the best possible position to focusing on recovering from your physical and emotional trauma; and 3) maximizing the compensation you receive from the wrongdoer or their insurance company.. Before rejoining the Rosenbaum Law Group as an attorney, I worked for six years as a paralegal at Rosenbaum Law Group. During that time I observed and recognized the powerful role lawyers can play in obtaining justice for people whose lives are turned upside down because of another person's negligence. I attended the Willamette University College of Law with the goal of becoming a lawyer who helps people, not corporations. At Willamette, I served as the Editor in Chief of the Willamette Law Review and graduated Magna Cum Laude. Because of the above, I possess a unique blend of legal, practical, and administrative experience that enables me to effectively represent my clients in their battle with insurance companies.

Proud to fight for injured people against insurance companies.. Joe is a successful trial attorney and younger half of the father/son team at Piucci Law.  A former Public Defender with extensive trial experience,  he understands what moves a jury and what motivates a judge to rule in his clients’ favor.. In his own words:  “I truly enjoy building relationships with clients and serving as their advocate. It’s deeply fulfilling to take on greedy insurance companies and corporate entities and prevent them from taking advantage of injured or marginalized people. It’s important to make companies pay when someone has been hurt – not just to cover pain and suffering but also to make them change their actions that led to the harm.”

I started practicing law in 1992.  I opened up my own practice immediately after graduating from law school and passing the bar exam.  For the first two years I mostly did criminal defense.  Then I started representing criminal defendants in civil matters:  they had been held in jail too long, or beaten by the police.  Then I began to represent people outside of the criminal law system injured in accidents  -- primarily car accidents.. I liked doing that sort of work (personal injury or "PI" work).  It tends to be less contentious and less stressful than some other areas, although no area of litigation is without its stressors, as conflict is inherent in the process.. When I cannot agree with the other side -- which is often, I am afraid -- I like to adhere to two concepts.  The first is to disagree without being disagreeable.  The second is to agree to disagree:  stop trying to convince the other side that I am right and get the case before a judge or arbitrator to settle the matter.

As a product of this great state, I have owned and managed my own law practice since 1991. Though the bulk of my work has been in the Portland metro area, I have represented clients throughout Oregon. My work has been fairly diverse including criminal, civil, probate and estate planning, etc. Over the years my expertise has become increasingly concentrated in the areas of insurance and personal injury disputes as well as elder law, probate, and estate planning. These are areas that have grown in complexity and require constant vigilance and discipline to keep up with important and frequent changes. My estate planning and elder law clients are particularly concerned about how they will be affected by changes to state and federal law. To be certain, this is an environment that demands the services of a steady hand and qualified steward to navigate through this challenging period. The legacy you have worked so hard to create will depend on having the right professionals working for you now and in the future. I have worked with many Oregonians to secure that legacy and I would like to work for you.. My practice continues to thrive in the Portland metro area, but I recently expanded its reach to open an office in sunny Central Oregon. I am very excited to bring my years of experience, discipline, and work ethic to the folks east of the mountains. I sincerely invite my fellow Oregonians from both sides of the Cascades to call me and give me the opportunity to serve their legal needs as I have for others since 1991.

I came to Portland in 1988 to attend law school at Lewis & Clark, Northwestern School of Law after completing my undergraduate studies at Whitman College in Walla Walla, WA.  I was raised in the country on the Kitsap Peninsula and more or less consider myself a native of the Pacific Northwest.  I've always had a deep love for the Portland, Oregon community, and I am proud to call it my home.  I have raised two children in the community over the past 32 years along with several cats and dogs.  My hobbies include cycling, hiking, mountaineering, downhill skiing, rafting and pretty much anything that gets me outdoors in the beautiful Pacific Northwest.. I began my legal career as a law clerk during law school for a firm that did both insurance defense work and plaintiff's personal injury cases on behalf of individuals.  Firms of this nature are rare in today's legal community because they are almost always one or the other...not both.  I worked 20 to 30 hours a week for the law firm during law school and attended classes full time. After I graduated in the top 20% of my class from law school, I passed the bar examination on my first attempt and began working at the same firm that I worked for during law school. My mentor was a senior litigation attorney who previously worked as a law professor part time at the Nothwestern School of Law when it was a night school in downtown Portland.  He was an excellent teacher, and he taught me how to try cases to juries in the courts of Oregon.  I was handling jury trials in my first year out of law school, which is almost unheard of these days.  I also had opportunities to "second chair" cases with the senior attorney for serious injuries as well as wrongful death.  When my mentor retired, I took over his case load of plaintiff's cases, and I have been primarily practicing on my own litigating cases on exclusively behalf of individual plaintiffs for over two decades. I no longer believe in representing insurance companies because I like to help people as opposed to furthering the monetary interests of Fortune 500 corporations.  My experience representing insurers in the past during the first five years of my legal career has given me special insight into their inner workings and methods.. My passion is to help regular people navigate the legal system as an advisor and advocate. Most of my clients have never hired a lawyer before. I am very loyal to my clients and strive to deliver the best result possible.  99% of my cases are handled on a contingency basis, meaning that if nothing is recovered, nothing is owed for my time.  I like the fact that I have skin in the game along with my clients.  It's what keeps me motivated and passionate.

Chris brought her mid-west ways with her to Oregon when she moved to Portland in 1989 after graduating from Valparaiso School of Law in northwest Indiana. An Illinois native ready for a new adventure, she began her career as a trial attorney while working for a sole practitioner who holds a state contract to defend persons charged with misdemeanor cases in East Multnomah County. Chris was tasked with managing the entire caseload and represented over 1000 clients in her four years as a defense attorney. That experience taught her not only basic trial skills but also how to effectively manage the demanding particulars of trial work and case management.. In 1995 Chris began a 20-year tenure as a prosecutor with the Multnomah County District Attorneys Office. During that time Chris prosecuted hundreds of cases ranging from DUII to Capital Murder (and everything in between). She has gone to trial and verdict on "too many cases to count" on crimes of domestic violence, robbery, burglary, arson, assault, gang-related matters, official misconduct, rape, kidnapping, sexual abuse, sodomy, manslaughter, crimes against the elderly, crimes against children, murder and aggravated murder. She was also a respected member of the East County Major Crime Team for over a decade and worked closely with a multi-agency group of law enforcement officers and detectives on cases, including officer-involved shootings. Chris was known in law enforcement circles as a "go-to" deputy district attorney. And for good reason: she always took the time to listen to the concerns of those investigating crime as well as the victims affected by crime and act in their best interest.. As a prosecutor, Chris worked extensively with victims and their families. It was through these interactions that Chris gained insight into understanding how trauma affects everyone differently and how best to approach survivors' concerns while guiding them through the legal process.. In 2015 Chris branched out from the confines of a government office and opened her own shop. At Mascal Law Office, she continues to work with people that need help navigating the legal process. Whether they be persons injured in an automobile accident, vulnerable victims of crime, those wronged by the thoughtless acts of others or anyone who needs a "go-to" attorney, Chris has the background, case experience and trial hours to do the job and do it well.

Matt grew up Bowling Green, Kentucky. He attended college at Miami University on a partial athletic scholarship. During his Junior year at Miami, Matt took a Business Law course that was taught by a local attorney. It was by far the most interesting course that Matt took in college and laid the foundation for his eventual career in the law. After graduating from Miami with a degree in Accounting and a minor in Political Science, Matt attended the University of Kentucky College of Law. During his third year of law school, Matt worked in the College of Law Legal Clinic, where he handled a number of pro bono cases for clients that couldn’t afford to pay a lawyer. Much of the work involved litigation of civil disputes and piqued his interest in civil litigation and trial work.. Matt obtained his law degree in 2005 and returned to Bowling Green to begin practicing law at a well-respected local firm. During his eight years at that firm, Matt handled a wide variety of cases, ranging from commercial litigation to insurance defense to representing plaintiffs in personal injury and wrongful death claims. Matt gravitated toward representing individuals that were harmed or killed through no fault of their own. He loved helping those clients and found it much more rewarding than the other work he had done.. In 2013, Matt joined his friend and law partner Brian Lowder to found Lowder & McGill, PLLC. Their firm was founded on the principle of zealous and aggressive representation of their client’s interest, whether it be a small business owner involved in a commercial dispute, an individual that has been seriously injured in a crash or a family that has lost a loved one due to someone’s negligence. Matt enjoys the challenge of obtaining justice for these clients, whether it be in reaching a fair settlement or taking his client’s case to trial.. Matt feels that it is his responsibility to give back to the community whenever possible. He is a former member of several civic organizations, has served as a board member for several charitable organizations and has contributed to and helped organize many fundraisers for these organizations. Matt currently serves as a board member and past President for Court Appointed Special Advocates (CASA) of South Central KY, an advocacy group that seeks to protect abused and neglected children.. Matt and his wife Amy have two beautiful daughters, Vivienne and Susanna.
