In the summer of 2006, she participated in a London Study Abroad program through the University of Miami Law School. For seven weeks, she lived in London and studied International Law at the University College of London. During this time, she also traveled to Paris, France, Oxford University, and several areas of Italy. In January 2012, Ashley opened up her own law firm, Schiavone Law, P.C. and is currently practicing as a solo practioner in the areas of general criminal defense (misdemeanor and felony cases), DUI, traffic law and uncontested divorce. We are a DUI defense law firm.  We represent drivers charged with DUI. DUI defense is one of the most complex areas of law.  Most DUI cases involve scientific evidence and questions of constitutional law.  It can be a mistake to assume you have no defense to a DUI arrest and plead guilty before speaking with an attorney.  Many DUI cases can be dismissed or reduced even before trial with the help of a knowledgeable DUI defense attorney.  In other cases, a jury trial may be your best and sometimes only option to beat a DUI.  In all cases, your attorney should prepare the case for trial to ensure the best possible outcome.. You should meet with several attorneys.  It is important you have confidence in the knowledge, skill and experience of the attorney you choose to represent you.  Keep in mind that cost, while important, should not be the determinative factor in hiring an attorney.  The cheapest attorney is usually not the least expensive attorney in the long run.. During your consultation, you should ask the following questions:. Have you tried DUI jury trials before this court?. Often attorneys take cases in courts they are unfamiliar with or in areas of law that they have little or no experience in.  A defense attorney unfamilar with a perticular court or area of law is at a disadvantage and that may affect the outcome in your case.  The defense attorney may not know of specific defenses applicable to your facts, or know about specific procedures unique to the judge who is hearing your case.  Your defense will be stronger if the prosecutor and the judge already know and respect your attorney.. What can you tell me about the arresting officer?. …the judge? …the prosecutor?. Knowing the “players” in your case will significantly increases the chance of beating a DUI.  An attorney who knows everyone involved can better gage what issues will be determinative and more accurately predict the outcome.. Have you ever won a DUI case similar to mine?. Ask about case specifics such as, if you gave a breath sample, ask if the attorney has won a breath test case?  If you have a DUI drugs case with blood test results, ask if the attorney has won a DUI drugs case with blood test results.  It is important your attorney know what it takes to win a case with your particular issues.  Be sure to ask for the court and court case number of any case cited as an example so you can confirm what you have been told.. What practice areas does your law firm handle?. To be fair, an attorney does not have to “just” practice DUI defense to be a strong DUI defense attorney, but if a large percentage of the attorney’s practice is not devoted to DUI defense, it is unlikely the attorney has the DUI specific knowledge, skill and experience necessary to win your case.. Will you be the attorney actually representing me in court?. Bait and switch is never a good thing!  Not when buying a product or retaining professional services.  You are selecting an attorney based upon your impressions during the consultation.  Make sure you are retaining the attorney who impressed you and not someone you’ll meet for the first time when they introduce themselves to you in the courtroom.. What DUI specific training do you have?. Ask the attorney to explain the standardized field sobriety evaluations, the Intoxilyzer 9000, the H.P. Gas Chromatograph (if a blood test is involved), the metabolism of alcohol in the human body, the elements of the offense(s) you are charged with, and the case law involved in the defenses available to you.  While you’re at it, consider asking why the attorney represents driver’s accused of DUI.. How do you expect to win my case?. Before you retain counsel, you should know how the attorney expects to win or resolve your case.  You should have a very clear idea of the issues, risks and likelihood of success.  If you were hiring a contractor to repair your home or a mechanic to fix your car, you would expect no less.  A DUI conviction is a serious matter.  Don’t be less careful hiring your attorney than you would be in choosing a mechanic or contractor.

I grew up in the shadow of my father, and I watched him build his law practice into a successful community based law firm.  I admired the way my father was able to truly help those that needed help, sometimes it seemed to me that my father was the only one that was able to help his clients.. As I matured and participated in the Mock Trial Program at school I recognized that I had a passion that would lead me into following my fathers footsteps.. Upon passing the Bar Exam for the State of Georgia, I was able to begin to build my practice alongside my father.. If you are in need of legal counsel, our firm offers an uncompromising level of communication, sincerity and honesty with our clients.  We will aggressively pursue justice for you and your family.

Practice Areas: DUI & DWI
Everyone needs help sometime…and I enjoy helping people! Being a criminal defense attorney allows me to assist good people who find themselves in need of legal assistance most often unexpectedly, unprepared and unaware of the law. When you are facing a criminal prosecution, you need an aggressive and experienced former federal prosecutor who will vigorously defend your rights. Please call or visit the Howard J. Weintraub law firm website at .. ---. Since 1985, Howard Jarrett Weintraub has been in the private practice of law in Atlanta, Georgia, where he has his own law firm. Mr. Weintraub's practice consists of primarily defending those individuals charged with violations of the federal criminal laws and those individuals charged with a Georgia DUI "driving under the influence" of alcohol and/or drugs, as well as with other state crimes. Mr. Weintraub's practice has taken him to the local courts throughout the State of Georgia, to all of the United States District Courts in the State of Georgia, and to the United States District Courts in the States of Alabama, California, Florida, Illinois, Maryland, North Carolina, Tennessee and Texas. Mr. Weintraub deeply believes in the proposition that, whenever the government is trying to take away or interfere in any way with the liberty of any individual, that person is entitled under our constitutional protections to the most vigorous and zealous defense permitted by our laws.. As a lawyer with more than 32 years of criminal law experience in state and federal courts, Mr. Weintraub has represented hundreds of individuals charged with a wide range of criminal offenses including: aggravated assault; armed robbery; bribery; child molestation; conspiracy to commit specified crimes; counterfeiting of United States currency; driving under the influence of alcohol and/or drugs; drug trafficking and possession; extortion; firearms violations; frauds against banks, businesses and United States government agencies; health care fraud; homicide (including vehicular homicide); money laundering; pension fund fraud; rape; stalking; tax violations; United States customs and munitions import and export laws violations; and voting fraud / election fraud violations.. Mr. Weintraub also has represented individuals who have had their currency and other property seized by law enforcement authorities who sought to forfeit such currency and property because of allegations of illegal criminal activities.. Mr. Weintraub's extensive experience has involved successfully negotiating transactional immunity from prosecution for certain clients; handling grand jury proceedings and other pre-indictment stages of criminal cases; conducting internal corporate investigations in response to the initiation of government investigations; participating in over 50 felony jury trials; and having federal sentencing proceedings result in the imposition of either a term of probation or a custody sentence markedly less than the amount of incarceration sought by the federal prosecutor and/or the United States probation officer.. Prior to starting his own firm in 1985, Mr. Weintraub gained much extremely valuable experience on how to vigorously defend those individuals charged with crimes during his tenure as an Assistant United States Attorney in the Northern District of Georgia from 1978-1985. As a federal prosecutor in Atlanta, Mr. Weintraub headed the Rome, Georgia division of the United States Attorney's Office for the Northern District of Georgia for a period of 1 1/2 years. At another time, Mr. Weintraub was the lead Assistant United States Attorney handling crimes being committed in the United States Federal Penitentiary in Atlanta. During this prosecution rotation, the Atlanta United States Penitentiary had more murders of inmates and correctional officers than any other federal prison, making it the most violent federal prison in the United States. In the last three years of his tenure as a federal prosecutor, Mr. Weintraub concentrated his efforts in the prosecution of white-collar fraud and public corruption cases.
