I currently have the premier Trucking accident firm in south Ga, and possibly the state. Discovery is the key to trucking cases. They are not simple garden variety car wrecks. These cases require a detailed mastery of the Federal Motor Carrier Safety Regulations, the Federal Rules of Civil Procedure and Federal Rules Of Evidence.. Lately, insurance/trucking defense firms are showing a penchant for removing cases with diversity citizenship to the federal arena, expecting to find a more conservative judge and jury, and a Plaintiff's attorney who is unfamiliar with its formality. Plaintiff's attorneys should know what to do when removal occurs, especially with regard to expanding discovery that is otherwise limited in the federal context.. Trucking defense law firms hire some of the most effective and polished lawyers in the country. They are good at what they do - minimizing the compensation due to an injured or dead plaintiff. They are also excellent at stonewalling legitimate discovery requests relating to the driver's or company's safety history.. A good Plaintiff's lawyer must have the staying power and drive to get to that "pot of gold" at the end of the rainbow. Too many lawyers will undersettle a case or should have referred the case at the outset to a more competent and better funded lawyer. A typical trucking case will take about three years to get to trial and cost the attorneys upwards to $100,, depending on the seriouness of the injuries.. You should ask a prospective attorney two questions: How many trucking cases have you handled in your career? and how many have you taken to trial? The bottom line is that you should know your attorney's track record before you hire him or her.
