What do you need to know about me as a professional? First, I am skilled at resolving disputes – nearly any type of dispute. Whether through litigation, arbitration, mediation or negotiation; in state or federal court --for plaintiffs or defendants. I have tried to conclusion and through appeals a wide variety of business and personal lawsuits. I am a Harvard trained mediator, and I bring this training to the aid of my litigation clients. Second, I treat every case from its inception as though it were headed to trial, preparing from the outset a strategy that adapts to the facts and the developing law, communicates persuasive themes, and which is built on an exhaustive development of the factual record. Whether arguing a motion to dismiss, a motion for summary judgment, or to a jury, my goal is to provide a simple yet persuasive story that compellingly states my client’s position. Third, I am a pragmatist. If a case should settle, then I advise settlement. If a case should go to trial, we will prepare accordingly. Every bit of advice is geared to maximize my client’s position. In my view, the key to ultimate success is starting from the beginning with a plan for trial. That preparation will dictate the outcome.. My practice focuses on civil litigation with an emphasis on business disputes, real estate, construction, and municipal law. I am available to mediate disputes in these areas, as well. I routinely advise business owners and executives on legal issues and help them through the decision making process.THIS IS AN ADVERTISEMENT

Tom began trying insurance defense cases almost immediately upon graduation from law school. He quickly developed a reputation as a trial lawyer, trying all types of cases ranging from automobile accidents, slip-and-falls, arsons, construction claims, and products liability. Tom’s reputation for relating to jurors encouraged other attorneys to refer clients with personal injury claims to him. Tom has successfully represented clients on both sides of the courtroom and sincerely believes that trying cases from both perspectives allows him to more thoroughly and objectively guide his clients through litigation. Tom’s experience representing both plaintiffs and defendants, combined with his reputation for reasonableness, has lead to a successful practice as a mediator.. Tom received an “AV” rating from Martindale-Hubbell at a relatively young age and continues to hold this highest designation. He has also been listed in the Kentucky Super Lawyers listing from 2008 – 2018, The Best Lawyers in America and Top 100 Trial Lawyers. He has served as a Special Justice to the Kentucky Supreme Court and was fortunate to write the opinion.. Tom has served on the Kentucky Bar Association Board of Governors since 2013 and is currently serving as President-Elect to the Kentucky Bar Association. Tom has remained an active alumnus for the University of Kentucky College of Law, serving as a Director for the College of Law Alumni Board and as President to the Alumni Association for three years, from 1997-2000. Tom has been active in the Bowling Green community by serving on various boards, including Crimestoppers, Fellowship of Christian Athletes (FCA), Rotary and Leadership Bowling Green Alumni Association and being a Little League coach for various sports.
