Understanding Criminal Defense Lawyers in Charlotte, North Carolina (28204)

Charlotte, North Carolina, located in the heart of Mecklenburg County, is a bustling metropolis known for its vibrant economy, rich history, and diverse culture. The 28204 ZIP code encompasses some of the city’s most iconic neighborhoods, including Elizabeth and Myers Park, where residents enjoy a blend of urban energy and suburban charm. However, like any major city, Charlotte faces its share of legal challenges, particularly when it comes to criminal defense.

Common Criminal Defense Legal Issues in 28204

Residents of Charlotte, especially in the 28204 area, encounter a range of criminal legal issues that necessitate the expertise of a skilled criminal defense lawyer. Common offenses include:

  • Driving Under the Influence (DUI): Charlotte sees a significant number of DUI cases, particularly given its nightlife and social scene.
  • Drug Offenses: Possession, distribution, and trafficking of controlled substances are prevalent issues, with law enforcement actively targeting these crimes.
  • Assault Charges: Violent crimes, including simple assault and aggravated assault, can arise in various situations, often leading to serious legal repercussions.
  • Theft and Burglary: Property crimes, such as larceny and breaking and entering, are frequent concerns, especially in urban settings.

These issues can lead to severe penalties, including fines, imprisonment, and a lasting criminal record, making it essential for those facing charges to seek professional legal counsel.

Local Case Examples

To illustrate the complexities of criminal defense in Charlotte, consider these fictional yet realistic scenarios:

  1. DUI Case: Michael, a 28-year-old graphic designer, enjoys a night out with friends in the Elizabeth neighborhood. After having a couple of drinks, he is pulled over for swerving. He fails a field sobriety test and is arrested for DUI. Michael hires a local criminal defense lawyer who specializes in DUI cases, allowing him to explore options such as plea deals or alternative sentencing.

  2. Drug Possession Charge: Sarah, a college student at nearby UNC Charlotte, is found in possession of marijuana during a routine traffic stop. Accused of possessing more than the legal limit, she faces misdemeanor charges that could impact her education and future employment opportunities. A Charlotte-based defense attorney helps her navigate the legal system, aiming for a reduction in charges based on first-offender status.

  3. Assault Case: David, a local barista, gets into a heated argument at a local coffee shop that escalates into physical confrontation. He is charged with simple assault. His defense lawyer investigates the circumstances, including witness statements, to build a case for self-defense, potentially minimizing any penalties he could face.

Typical Lawyer Fees in 28204

Legal fees for criminal defense lawyers in the 28204 area can vary widely depending on several factors. On average, hourly rates may range from $150 to $500, with some attorneys offering flat fees for specific types of cases. For example, a DUI defense might cost around $2,500 to $5,000, while drug-related cases can be similarly priced, depending on the severity of the charges. It’s important for defendants to discuss payment plans or retainer options during initial consultations.

Why Hiring a Local Lawyer Helps

When facing criminal charges, hiring a local attorney can provide significant advantages. Local lawyers have a comprehensive understanding of the Charlotte legal system, including judges, prosecutors, and court procedures specific to the 28204 area. They are familiar with local laws and practices, which can be crucial in building a robust defense strategy. Moreover, a local attorney is more accessible for consultations and can provide personalized attention to each case, ensuring that the legal process is as smooth as possible.

I have dedicated my entire legal career to criminal defense, through direct representation as well as policy work. Upon graduating from the University of North Carolina School of Law in 2008, I began my legal career as an assistant public defender in Mecklenburg County, protecting the rights of defendants who could not afford otherwise afford legal representation in District and Superior Courts. From 2014 to 2017, I worked for the National Association of Criminal Defense Lawyers in Washington, D.C., organizing training for public defenders and private assigned counsel and advancing reform efforts in various states. From 2017 to 2023, I returned to public defense, working to defend the rights of the accused in serious criminal cases in Camden, New Jersey. In 2023, I returned to North Carolina to continue my career as a criminal defense attorney with The Olsinski Law Firm.. I represent adults charged with misdemeanor and felony offenses in District and Superior Court primarily in Mecklenburg County. I occasionally take cases in surrounding counties, such as Cabarrus and Union, and I am admitted to practice in the federal court of the Western District of North Carolina. Although I represent people charged with a variety of crimes, I have a particular interest in domestic violence defense and cases with Fourth Amendment issues - seeking to keep out evidence that the government obtained in violation of the Constitution. I greatly value communication and strive to always make sure that clients understand the status of their cases, the evidence, and their options.. I am a member of the Mecklenburg County Bar, the Cabarrus County Bar, and the Mecklenburg County Criminal Defense Lawyers Association. I also am a member of the North Carolina Advocates for Justice, including the Criminal Justice Section and the Women's Caucus, and am serving as an Education Co-Chair for the NCAJ Women's Caucus in 2024-2025. My husband and I live in Charlotte with our large rescue dogs. Outside of work, I enjoy traveling, reading, playing games of all kinds, and dining out at Charlotte's many fabulous restaurants. I am also an active member of the Alpha Gamma Delta Charlotte Alumnae chapter.

DWI & CRIMINAL DEFENSE "From Stop Signs to Murder". Criminal and traffic cases can be more complex than they seem, and if you are in the hands of an inexperienced attorney who does not know what he or she is doing, you can end up with awful results. You don't have to worry about that with me. I've been practicing in Charlotte for over 30 years. My practice is focused entirely on traffic violations, misdemeanors, and felony charges. Some attorneys try to practice in several areas of the law, but I concentrate on one area only so that I can maintain the highest level of expertise in my field.. If you are interested a little background about me, I am a North Carolina native. I attended Charlotte Country Day, and then Duke University, where I was proudly the mascot for the Blue Devils. I received a scholarship to attend law school at Mercer University in Georgia. I have two wonderful kids and am extremely active in their school and sports activities, both as a volunteer for the schools and as a softball/baseball coach for many years.

Location: 28204, Charlotte, North Carolina

Firm: DeCurtins Law Office

Robert DeCurtins has lived in Charlotte since 1984 where he and his wife have raised their three children and he began his legal career.  Over the past 25 years he has successfully represented many thousands of clients in state criminal court in Charlotte, Mecklenburg County and nearby counties.  He enjoys his relationships with his clients, past and present, and looks forward to getting to know his future clients.. Robert was born in Miami Beach, Florida on March 20, 1954, and grew up in Dayton, Ohio .  He attended college at Eastern Kentucky University where he graduated in 1976 with a Bachelor’s degree in Criminal Justice and a minor in Psychology.. His first job out of college was with Montgomery Ward as a security director for a new location.  Responsibilities included hiring and training a staff of store detectives to apprehend shoplifters and all internal investigations of employee theft and embezzlement.. While working in that capacity Robert was introduced to the field of polygraph (or lie detector) and later graduated from the Lincoln Zonn Institute of Polygraph in Miami, Florida where he graduated 2nd in his class, which consisted mostly of police officers from around the country.  He was hired by the Zonn Security Corporation upon graduation and trained in New York city for a period of time under a nationally renowned polygraph examiner and interrogator who had conducted polygraph testing on witnesses surrounding the President Kennedy assassination.. Eventually, Robert accepted a position in Dayton, Ohio with Takkon Polygraph Firm which was owned and operated by Dayton Police Department homicide investigators and was the largest private firm in the Ohio/Kentucky/Indiana area.  While there he testified in criminal court as a polygraph expert.  Robert believes his polygraph and interrogation experience has been invaluable in his career as a criminal defense lawyer, having personally conducted approximately 8,000 polygraph examinations.  He also was eventually granted a state license to administer polygraphs in North Carolina .  Robert is possibly the only lawyer in North Carolina to have held such a license.. With an educational and job background in the criminal justice area, Robert began law school at the University of Dayton School of Law in 1980, obtaining his law degree in 1983.  Mr. DeCurtins then moved his family to Charlotte, North Carolina and began his legal career as an Assistant Public Defender.  In 1985 he left that office and went into private law practice.  At that time, Mr. DeCurtins helped prosecute child support arrearage cases in Charlotte .  In addition, he also represented the City’s interest in front of the Civil Service Board where his job was to have the board uphold punishments, i.e. suspensions or termination, handed down by the Charlotte Police Department for officer misconduct.. Throughout his career Robert has probably defended clients charged with almost every type or category of criminal case in North Carolina .  Of his most memorable cases to date were two separate instances where he defended Charlotte teachers who were accused of having sex with a student.  In one of the cases his client was a male teacher and in the other a female teacher.  The case involving the female teacher generated significant media interest on a national level because of the rarity of a female teacher being charged and several television shows, i.e. 20/20, sought interviews and or appearances.. Mr. DeCurtins also represented a NFL Carolina Panthers player during the Rae Carruth murder investigation and prosecution in Charlotte, North Carolina .  At that trial, approximately one year after the investigation started, both Robert and his client were called to testify..
