In these areas, he has appeared before federal and state courts, the Provider Reimbursement Review Board, Administrative Law Judges, state agency administrative hearings, and in medical staff hearings.. Jim represented a hospital in Riverside Methodist Hospitals v. Tommy Thompson (2003 U.S. Dist. LEXIS 15163, 2003), overturning disallowance of residents in IME count based on nature of residency program activities; represented the Ohio Hospital Association in OHA v. Shalala (201 Fed. 3d 418, 1999), successfully challenging the government's use of the False Claims Act in Ohio's laboratory unbundling litigation; and represented a hospital in Rush-Presbyterian-St. Luke's Medical Center v. Shalala (1997 U.S. Dist. LEXIS 13224, 1997), ordering the government to update reasonable compensation equivalent (RCE) limits.
