Matt founded the firm and assembled our team based on his belief that traditional law firms do not adequately serve the business community. There, he focused on representing large national and regional clients with a variety of business and litigation matters including highly complex commercial disputes, corporate governance matters, and regulatory compliance.

Kelly is also active in the East Greenbush School District community, serving as an active member and co-vice president of the Donald P. Sutherland PTO.  She serves on the Board of Directors of the Brain Injury Association of New York State and is a member of the New York State Trial Lawyers Association, the Capital District Women’s Bar Association, and the Bar Associations of New York State, Albany County and Rensselaer County.

I am a trial lawyer who focuses his practice on the representation of clients in serious personal injury cases.  I have experience handling Motor Vehicle, Medical Malpractice, Premises Liability, Products Liability and other Personal Liability matters, and have successfully resolved numerous cases on behalf of my clients.. Recently, I obtained a $1.4 million dollar settlement for my clients who were catastrophically injured in a complicated motorcycle/automobile accident involving multiple defendants.  I was also part of the trial team which obtained a $1.1 million dollar verdict for clients seriously injured in an automobile accident, one of the largest Albany County verdicts in over a decade.. Prior to joining DeGraff, Foy & Kunz, LLP, I practiced as an associate at a well-established personal injury firm in the Hudson Valley, and before that, at a large litigation firm in Albany.  I received my law degree from Albany Law School, where I won the Best Oral Advocate Award in the Domenick L. Gabrielli Appellate Advocacy Moot Court Competition.  I earned my undergraduate degree from Villanova University.

David Cost is a litigator who counsels a broad array of clients including commercial clients across multiple industries as well as individuals on the local, state and national level. He has successfully represented clients in personal injury, property damage, civil rights, subrogation and commercial litigation lawsuits in both state and federal court, at the trial and appellate level.. David also specializes in mass tort litigation claims involving exposure to toxic chemicals, including representing corporate clients in asbestos cases around the country, as well as lead paint matters. He also has experience in matters involving complex business disputes, claims brought under New York State Labor Law, workers compensation group self-insurance trusts, media law, as well as insurance defense, which includes both jury trial and substantial motion practice.. Pro bono work also plays a significant role in David’s legal practice. In 2011, the Legal Project of Albany awarded him the prestigious Stanley J. Rosen Memorial Award for his pro bono service to victims of domestic violence. He also was lead trial counsel for a prisoner plaintiff in a Federal civil rights matter for denial of Constitutional Due Process Rights and Equal Protection Violations.. David has also been a presenter at multiple national conferences and serves on several firm and organizational committees. He began his career with the firm as a summer associate in 2005, he also served as a legal clerk to two energy and utility companies while attending law school.
