It is my mission to serve you with first-class customer attention by zealously advocating on your behalf. This means having an understanding of the client's position and the empathy for why they are seeking representation.. Throughout my career as a prosecutor, I've tried cases to a jury from a traffic violation to a capital murder and many crimes in between. I proudly represented the community of Austin in the prosecution of the SXSW capital murder trial and the Tarrytown Murder. It is now time to use my trial and litigation experience to serve you and other citizens in the best possible way.I was born and raised in Lubbock, Texas. I graduated Lubbock Christian University with a Bachelor's in Business Administration. From there I attended Texas Tech University where I graduated with my Law degree and a Master's in Business Administration.I began my legal career in San Antonio representing citizens accused of crimes as well as business owners in civil manners. Following that, I served as Assistant District Attorney of Lubbock County for nearly four years. For the past 8 years, I served as Assistant District Attorney for Travis County. Since then, I started my own practice in early 2018 serving the people of the Greater Austin Area.

I have wanted to be a trial lawyer since I was 6 years old.  At that age, I read a short story called "The Devil and Daniel Webster."  Long story short: after reading it, I knew that being a lawyer could be something heroic, that I could help people who desperately needed help.. After graduating from law school, I worked as a briefing attorney for United States District Judge Robert W. Porter.. After completing my term with Judge Porter, I started working at the Austin law firm of Clark, Thomas & Winters.  I handled white collar (RICO) cases, insurance cases, and commercial matters.. My thirst for trials would only be quenched, though, once I started working for the Travis County District Attorney's Office.  I worked in these units: juvenile prosecution, trial court (assigned at various times to the 167th, 299th, and 390th District Courts), grand jury, child abuse prosecution, and the special prosecution (white collar crime) unit.   I was made the first "court chief" of the 390th District Court.. Now I continue representing clients in my criminal defense practice.  I love it.  It allows me to continue helping people, defending the accused both in trial and in negotiations, whichever is more appropriate for my client.

I have tried over 40 jury trials as lead counsel, from voir dire to verdict, and assisted as secondary counsel on countless others. I have dedicated my practice to the art of jury trials, including preparation, planning, strategizing, selecting a jury, and the battle of a contested case. I take pride in representing my clients through extremely trying circumstances in their life, and am proud to have secured Not Guilty verdicts on their behalf. It takes someone who knows what they are doing in a court room to defend anyone accused of a crime in Texas. I am unafraid to stand and deliver in front of a group of strangers and advocate voraciously on my client's behalf.. I grew up in Houston, Texas, both in my personal life and attorney life. I learned how to defend DWI and Criminal Defense cases in the 4th biggest city in the nation, practicing there for four years until relocating to Austin, Texas. Now I am proud to offer my services to all citizens accused in the Austin, Travis County, and surrounding areas, inclunding Williamson County, Travis County, Hays County, and Bexar County.

Firm: David B. Frank, Attorney & Counselor at Law, PLLC

David Frank is based in Austin, Texas and has a reputation for being a tough and experienced criminal trial lawyer.  In April of 2014 he successfully challenged the Texas Mandatory DWI Blood Draw Statute.  The Court of Appeals reversed the trial courts in his two cases and found that the Mandatory Blood Draw Statute runs afoul of the Fourth Amendment warrant requirement.  In November 2014 he helped lead a State-Wide effort against a State Office of Administrative Hearings rule change that would have significantly hampered the right to subpoena witnesses for ALR Hearings.  David Frank has been an attorney since 1992. He is Board Certified in Criminal Law by the Texas Board of Legal Specialization. Mr. Frank has devoted his practice to representing individuals accused of crimes. His practice includes defending against all felony and misdemeanor charges. He aggressively represents clients who live throughout the state of Texas as well as clients living abroad. He is a Past President of the Austin Criminal Defense Lawyers Association and regularly speaks at criminal law seminars.  He uses the latest electronic legal research tools to find cases that help his clients get results. His many years of practice in the Austin and Travis County have given him a particular insight in dealing with the courts. Avoiding frivolous charges and unfair penalties is the primary goal. Mr. Frank explores alternatives to incarceration as he works to resolve his cases. He works with the prosecutors and the judges every day -- and that is essential to being effective in the courtroom.
