Firm: DeCurtins Law Office

Robert DeCurtins has lived in Charlotte since 1984 where he and his wife have raised their three children and he began his legal career.  Over the past 25 years he has successfully represented many thousands of clients in state criminal court in Charlotte, Mecklenburg County and nearby counties.  He enjoys his relationships with his clients, past and present, and looks forward to getting to know his future clients.. Robert was born in Miami Beach, Florida on March 20, 1954, and grew up in Dayton, Ohio .  He attended college at Eastern Kentucky University where he graduated in 1976 with a Bachelor’s degree in Criminal Justice and a minor in Psychology.. His first job out of college was with Montgomery Ward as a security director for a new location.  Responsibilities included hiring and training a staff of store detectives to apprehend shoplifters and all internal investigations of employee theft and embezzlement.. While working in that capacity Robert was introduced to the field of polygraph (or lie detector) and later graduated from the Lincoln Zonn Institute of Polygraph in Miami, Florida where he graduated 2nd in his class, which consisted mostly of police officers from around the country.  He was hired by the Zonn Security Corporation upon graduation and trained in New York city for a period of time under a nationally renowned polygraph examiner and interrogator who had conducted polygraph testing on witnesses surrounding the President Kennedy assassination.. Eventually, Robert accepted a position in Dayton, Ohio with Takkon Polygraph Firm which was owned and operated by Dayton Police Department homicide investigators and was the largest private firm in the Ohio/Kentucky/Indiana area.  While there he testified in criminal court as a polygraph expert.  Robert believes his polygraph and interrogation experience has been invaluable in his career as a criminal defense lawyer, having personally conducted approximately 8,000 polygraph examinations.  He also was eventually granted a state license to administer polygraphs in North Carolina .  Robert is possibly the only lawyer in North Carolina to have held such a license.. With an educational and job background in the criminal justice area, Robert began law school at the University of Dayton School of Law in 1980, obtaining his law degree in 1983.  Mr. DeCurtins then moved his family to Charlotte, North Carolina and began his legal career as an Assistant Public Defender.  In 1985 he left that office and went into private law practice.  At that time, Mr. DeCurtins helped prosecute child support arrearage cases in Charlotte .  In addition, he also represented the City’s interest in front of the Civil Service Board where his job was to have the board uphold punishments, i.e. suspensions or termination, handed down by the Charlotte Police Department for officer misconduct.. Throughout his career Robert has probably defended clients charged with almost every type or category of criminal case in North Carolina .  Of his most memorable cases to date were two separate instances where he defended Charlotte teachers who were accused of having sex with a student.  In one of the cases his client was a male teacher and in the other a female teacher.  The case involving the female teacher generated significant media interest on a national level because of the rarity of a female teacher being charged and several television shows, i.e. 20/20, sought interviews and or appearances.. Mr. DeCurtins also represented a NFL Carolina Panthers player during the Rae Carruth murder investigation and prosecution in Charlotte, North Carolina .  At that trial, approximately one year after the investigation started, both Robert and his client were called to testify.. He has tried dozens of jury trials and does not shy away from trying a case if it is necessary.. His work also frequently involves representing individuals and companies who are the subject of investigations who want to know their legal options and whether steps can be taken early on to protect themselves. In many cases, he has kept his clients from being charged, and their names from ever seeing a news reel.. His cases have been prominently featured in media including the New York Times, the BBC, L.A. He is experienced in state and federal criminal appeals, and in post-conviction relief. He has had success overturning decades-long sentences for clients. For example, he obtained reversal of a client’s 35-year sentence based on insufficient evidence of the client’s knowledge of criminal wrongdoing from the N.C Court of Appeals. In 2019, he obtained reversal of a synthetic drug conspiracy conviction based on improper venue. In 2018, he overturned a 50-year murder sentence based on the ineffective assistance of the client’s trial lawyer, and overturned another conviction on direct appeal where the client had not been properly advised of his rights to counsel. He obtained a 100-month sentence reduction on remand for another State client, and obtained a remand for resentencing from the Fourth Circuit for a 2-year reduction for another client. (read more). He has scores of other victories where cases have been overturned on appeal or when challenged in post-conviction proceedings.. He has a number of other exciting appellate challenges working their way through the courts including a habeas corpus challenge to the immigration detention policies in North Carolina, where the ACLU and Just Futures have joined the litigation, as well as a First Amendment challenge to our jury intimidation statute in which renowned legal blogger Eugene Volokh is arguing with Mr. Heroy. The last case involves the defense of an attorney where Rob is challenging her conviction based on arbitrary enforcement by federal law enforcement. In this case and dozens of other cases, he is the lawyer that lawyers call when they need assistance, either with criminal charges or investigations or with disciplinary proceedings.. Rob also litigates immigration matters in federal district court and federal courts of appeal. In some cases, he has obtained court orders compelling immigration to grant relief to individuals or release them from detention, and in others he has obtained relief by appealing arbitrary immigration decisions to the Fourth Circuit Court of Appeals. He has presented at continuing legal educations seminars before other attorneys on the subject of immigration law and has been accepted as an expert witness in the area of immigration law in North Carolina Superior Court.Business North Carolina Magazine selected Rob to the Legal Elite every year since 2010, an award in which Business North Carolina polls attorneys to vote for the top 3 percent of attorneys in their field. People turn to an attorney when they need help dealing with a problem that has become too large for them to handle on their own. Every day, I see clients in difficult situations they did not create, dealing with pain they didn’t have before, trying to pay for medical expenses they can’t afford. And all the while, a large corporation or auto insurance company is trying to minimize what the victim is going through.. As an attorney licensed in North Carolina, Virginia, and Washington, D.C., Brad represents personal injury clients in cases throughout the Mid-Atlantic States. He began his legal career as an attorney with the Legal Aid Society of NW North Carolina (now known as Legal Aid of North Carolina), fighting for the rights of those who could not otherwise afford legal representation. Brad still volunteers his services through legal aid societies to clients on a pro bono basis.. Helping personal injury clients. As long as he can remember, the idea of being able to advocate for those unable to do it for themselves has been Brad’s cause. A serious injury can completely destroy the personal, financial and emotional well-being of a client. Brad often helps clients injured through the negligence of others gain access to medical care and other resources until their cases can be settled or won at trial.. Protecting the rights of NC individuals to legal counsel. Brad’s early history provided the foundation for his continuing interest in protecting the individual’s rights to legal counsel in his state. Several legislative initiatives in North Carolina are threatening to limit the ways in which people can research and obtain legal representation. Backed by powerful insurance companies, these proposed laws seek to curtail an attorney’s ability to reach out to prospective clients. Brad works with several professional organizations to fight these initiatives.. - See more at: #

My practice is really all about my clients.  They talk, I listen,  I ask questions, they tell me what is important to them, what they value, and what they wish to see happen in the event they become disabled or when they die.. To help break the ice with new clients, I frequently wear neckties that are a little out of the ordinary (i.e. No Boring Ties!).  As you can see from the picture in the section below.  If you look at the photo at the top of the page, you'll see that it doesn't hurt if you lose 30 pounds and get a new hair style, too.. Even though we are planning for unhappy events, we still can enjoy today, and laugh at some of my strange neckties, too.
