Representation of Individuals and Business in Complex Litigation. Mr. Cushing regularly represents persons who have sustained severe personal injuries and other substantial losses. He has represented persons who have suffered personal injuries from automobile accidents, construction site accidents, fall downs, defective or dangerous products, fires, and other traumatic incidents. Representation of Government Entities. Mr. Cushing represents numerous municipalities, school boards and counties as either special counsel or municipal counsel. In addition, he has been engaged to represent hundreds of municipalities, school boards, counties, authorities and other public entities in claims against them involving harassment, discrimination, civil rights, sexual harassment, housing discrimination, sewer, water, defective, roads and disputes involving police misconduct. He represented a large Bergen County municipality in a two hundred million-dollar claim by a developer who asserted the municipality purposely delayed his development, causing it to fail. He represented the Borough of Bernardsville in a claim against it by a quarry alleging thirty million dollars in loss. After a trial in which the Borough prevailed, the case was successfully defended in the Supreme Courts of New Jersey and the United States. The New Jersey Supreme Court Opinion in the matter has become a landmark case in New Jersey, Bernardsville Quarry v. Bernardsville 129 N.J. 221. Mr.Cushing is the author of "A Survey of Municipal Immunity in New Jersey", 3 Seton Hall L.Rev 416 (1972) and coauthor of "Sewer Service: Possible Anti-Trust Liability?", N.J. Municipalities, Volume 63, No.6, (June 1986).. Mr. Cushing has also been a frequent lecturer to mayors, township governing body members, police chiefs, law enforcement officers and other municipal officials with respect to municipal issues, and has written extensively on public entity issues.. Mr. Cushing is regularly asked by insurance companies to defend the interest of their insureds in public entity cases, complex construction, general liability, fire and fraud cases. Mr. Cushing represented the JUA/MTF, a state chartered insurance organization, in a fraud action where two chiropractors sought nearly fifty-million dollars in recoveries from it. Mr. Papay has also handled successful insurance fraud prosecutions against other health care providers, including various neurologists, pain management physicians, and providers of electro-diagnostic testing, diagnostic testing, and radiographic imaging.  In addition, Mr. Papay has successfully litigated challenges to the reimbursements sought by a large physical therapy practice, and, through several reported decisions, has helped shape law in this area more favorably for carriers. While in law school, Davis was also on the editorial board of the South Carolina Law Review.. Upon graduating law school, Davis worked three years with an insurance defense litigation firm in Charleston, South Carolina, providing him with an invaluable perspective in evaluating and handling personal injury cases.. Channing Miller, formerly Watson, is a Clinton Dragon, graduating in 2005 from Clinton High School. After high school, she went on to the University of Tennessee at Knoxville, where she graduated with honors with a Bachelor of Arts in Political Science with a minor in Philosophy. During her undergraduate studies, Channing was the recipient of the General Assembly Merit Scholarship, the Edgar Guenther Scholarship, the Volunteer Scholarship, and the HOPE scholarship. She spent a summer during her undergraduate studies interning for Senator Bob Corker at his Knoxville satellite office. After joining the workforce for a year, Channing went on to pursue her legal degree at the University of Tennessee College of Law. She participated in Homer A. Jones Wills Clinic where she was able to assist economically disadvantaged clients with estate and trust planning. She also participated in the Non-Profit Clinic while in her 3rd year and assisted a non-profit in their start up adventures. Channing clerked at Ritter and Biloski during her time in law school Channing was licensed to practice in November 2013 and moved positions from clerk to attorney at Ritter & Biloski. Channing’s practice focuses on domestic relations law including divorce, child custody, and adoptions, juvenile law, and estate and probate matters, including wills.. Channing was married in 2012 to Gabriel Miller. They are members of Temple Baptist Church in Powell and currently live in the Claxton area with their dogs, Banjo and Shiloh. Bruce Fox is a partner and co-founder of Fox & Farley.  His personal injury practice focuses on automobile accidents, workers’ compensation, products liability, hospital and nursing home injuries, and trucking litigation.  In addition, Bruce has significant multi-state lead counsel Class Action litigation experience against a variety of defendants.  Bruce is co-founder of the Energy Workers’ Legal Resource Center in Oak Ridge, Tennessee, a law firm dedicated to helping local energy workers sick with serious lung diseases, cancers and hearing loss as a result of their work for various Department of Energy contractors.. Bruce has practiced law for over forty years, and has tried over 125 state and federal jury trials to completion, and has tried over 400 nonjury cases as well.  Most of his clients are referrals from past clients and other attorneys, and many of Bruce’s clients have sought his counsel and representation on a repeated basis over the years and decades.. Bruce grew up in Clinton, Tennessee.  At home in the hills of rural East Tennessee, Bruce’s physical surroundings were humble, but he was rich in the love of his parents and family. From them, he learned the value of hard work, integrity, and fairness.. Bruce attended college and law school at the University of Tennessee. Upon graduation from the University Of Tennessee College Of Law, Bruce left to study in England, at Cambridge University.  Bruce completed an advanced law degree at Cambridge, and holds a LLB in International Law. He is a current Master of the Bench of the Hamilton Burnett American Inn of Court in Knoxville.  He is one of approximately 100 Tennessee lawyers selected for membership by the American Board of Trial Advocates (ABOTA). In 2011 he received the Paladin Award for East Tennessee from the Tennessee Trial Lawyers Association. The award recognizes TTLA members who achieve outstanding results for a client despite great obstacles, and who work to protect the civil justice system.. Bruce serves on the Executive Committee and the Board of the Tennessee Trial Lawyers Association.  In 2007, 2008, 2009, 2010, 2011, 2012, 2013, 2014, 2015, and 2016 he was named to the Mid-South Super Lawyers.  In 2008, 2009, 2010, 2011, 2012, 2013, 2014, 2015, and 2016 Knoxville’s Cityview Magazine named Bruce one of the area’s best lawyers in the areas of workers’ compensation, hospital litigation, nursing home neglect, auto accident, class action, personal injury and wrongful death.. Bruce is a frequent speaker and lecturer to attorneys and judges at seminars and legal education forums throughout the Southeast and Midwest.  He has taught on topics ranging from underinsured and uninsured motorist coverage to Tennessee Workers’ Compensation Law to automobile and truck accident law.. In early 2008, Tennessee Governor Phil Bredesen appointed Bruce to serve as a member of Tennessee’s Workers’ Compensation Advisory Council, and Governor Bill Haslem re-appointed him in 2011.  Bruce works in this capacity to shape legislative policy and law applicable to the rights of injured workers in Tennessee.. Bruce believes strongly in the rights of children, particularly injured or special needs children.  He works with the East Tennessee Chapter of the Autism Society of America in its efforts to raise funds and promote awareness of autism and autism related issues.  Bruce has contributed many hours towards the goal of increasing autism awareness through public and private fundraising to benefit the East Tennessee Chapter of the Autism Society of America.. Bruce is married to Mary Jane Fox and lives in Knoxville, Tennessee.  He has six grown children, seven grandchildren, and two more on the way.  Away from work, Bruce spends time with his family, enjoys traveling, and has traveled extensively throughout Europe. He is an avid snow skier, hunter, golfer, and dotes on his beloved Labrador retrievers, Ty and Woodrow, which he runs and handles in AKC Hunt Tests and Field Trials.. Areas of Practice
