If two words can describe my approach to litigation, they are "aggressive" and "prepared." Litigation is a very serious step and often involves claims that are financially and emotionally costly due to their personal nature. I understand that most clients in this situation want an advocate—someone who will vigorously defend them against what they view as frivolous attacks on personal integrity. But it is important to remember that the ultimate test of a lawyer's effectiveness is the value delivered as compared to the cost. Blind or blanket aggression can destroy the cost/benefit proposition. Aggressiveness without preparation and knowledge is a credibility sapper. Seasoned litigators prey on the form-over-substance types. But aggressiveness built on a thorough knowledge of the facts of the case and applicable law is virtually unbeatable.. Litigating contract issues for over twenty years has given me critical insight into ways to minimize contractual and transactional risk on the front end—before the contracts are finalized and signed. True story: I had a two week trial in federal court in Mississippi over whether my clients had breached non-compete and non-solicitation covenants—and the main legal issue revolved around the meaning of the word "otherwise." Of course I cannot say that all disputes can be avoided with shrewd contract drafting, but I can say with confidence that important—and ultimately expensive—ones can and therefore should be.
