I have been successful in trying cases to jury trials and also dealing with prosecutors in getting the very best plea for my client.  This includes dismissals, Reckless Driving, Deferred Judgement and Sentence (DJS), DWAI, and other outcomes.. There are many ways you can "win" with your DUI case.  Sometimes a person has a record of prior "DUI" convictions and if we cannot beat the evidence in your case, then getting very little jail and work release is what that client considers a "win" in his/her case.  Also, there are other ways to win.  You can go to trial and win and get acquitted; or you can get a "Non-Alcohol" result such as a plea to Careless Driving or Reckless Driving.  I have gotten many of these for my clients.  Also, there is a "Deferred Judgment and Sentence" in some jurisdictions which means that after you do the treatment and other requirements, the Court will DISMISS your case.. There is a lot of evidence to look at in a DUI case.  What makes your case different from a "criminal case" is that much of the evidence in your case is science based.  That is why I go to DUI science based trainings and am a member of the College of Drunk Driving Defense and a founding member of the DUI Defense Lawyers Association.  These provide specialized training to be able to defend YOU.. There is an important part of your defense that needs a good criminal lawyer.  I have been also practicing criminal law for years.  I will look at how the law enforcement officer "stopped" your car (4th Amendment violation), if the officer "interviewed you while in custody" (Miranda Rights), and determine if there really was "probable cause" to arrest you.. I am Daniel Mossinghoff and I am proud to be the Criminal Defense Director for Baumgartner Law, LLC. I have been a criminal defense trial attorney for almost all of the years I have been practicing. I am dedicated to protecting the rights of anyone accused of a crime and vindicating those wrongfully charged.. I graduated Magna Cum Laude from Regis University in 1996 and then graduated law school from the University of Colorado in 2000. As a fledging lawyer, I cut my teeth and learned trial work as a district attorney for four years. Fairly quickly, I realized I was not meant to work as a prosecutor and quit. I missed working with people and arguing to protect our Constitutional rights.. Since then, I have been a criminal defense attorney for the last 16 years. I have defended thousands of clients in the areas of DUI defense, juvenile law, domestic violence and major felony cases--including homicide. I have tried over 250 jury trials and countless motions hearings. I have also presented or been published over a half dozen times in multiple areas of criminal defense.. I also now represent citizens in Civil Rights cases with an emphasis on police misconduct and police brutality.  This is a specialized area of law which many attorneys do not practice.  Baumgartner Law specializes in this area.  I find litigating Civil Rights matters is a natural evolution in my practice of criminal defense.  Although this is a very challenging area of law, I also believe it has made me a much better attorney who can now focus on offering remedies to people who have suffered from police misconduct instead of only offering a defense.
