My legal career has been exclusively about litigation. Initially as an insurance defense attorney and general practitioner. During my years as a civil defense attorney, I learned much about the defense playbook. Over time, My interests and practice shifted primarily to representation of injured workers and those injured due to the negligence of others. My experience with defense work has been very helpful in determining case values and litigation strategies.. What is most enjoyable about my practice is helping others. The legal system is not engineered for prompt resolution of disputes. That function therefore must rest upon the attorney, and not all are equal. Good results require prompt, thorough, and accurate case evaluation and a strategy for resolution. Implementation of the strategy is best achieved by joint and coordinated efforts of the attorney and client. The simple rule that I have always followed is to handle the case no differently than I would want it handled if I were the client.

My approach to the practice of family law is client-centered. In other words, my goals are to make you feel comfortable and cared for as a person as well as to provide you with top notch legal advice and legal representation.. Most of my cases - even the high conflict ones - settle out of court, which is the best outcome because it allows you to remain in control of how you will parent your children and how you will divide your assets and debts rather than allowing a judge to decide based on the limited information that is admissible in court. To have a collaborative divorce, both parties must agree to participate in the process, to disclose all relevant information, and to retain an attorney with the required training. If your spouse is not represented by a collaborative attorney, settlement is still possible through mediation or through more traditional negotiation.. If you and your spouse choose to resolve your marital problems through the process of mediation, your mediator will be a neutral who cannot provide you with legal advice or protect your individual interests.  I can represent you in this process to make sure you understand the law and make good decisions.  Alternatively, I am able to serve in the role of the neutral mediator.. If a fair settlement is not possible, I am prepared to advocate for you to the judge. Ms. Hayba is a native of New York and received her undergraduate degree, summa cum laude, from Rutgers University. Ms. Hayba went on to obtain her Juris Doctor degree, magna cum laude, from The Pennsylvania State University, Dickinson School of Law and is admitted to practice in both Virginia and New Jersey.. Ms. Hayba is an active participant in the Northern Virginia legal community, including as a member of the Family Law and Young Lawyers Sections of the Fairfax Bar Association. Ms. Hayba has been recognized as a “Rising Star” by Virginia Super Lawyers in 2019 and 2020.
