My practice focuses on commercial and complex civil litigation, with an emphasis on business torts such as fraud, unfair trade practices and violations of intellectual property rights. The bulk of my caseload arises from investments, business contracts and leases, banking and real estate transactions, shareholder disputes, and construction projects. I have also successfully litigated cases involving non-compete agreements, libel/defamation and Constitutional issues. And at any given time, I usually have at least one bizarre case that simply cannot be categorized. A number of those disputes have garnered national media attention. Because of the multifaceted nature of the litigation I specialize in, I also have significant experience in associated procedural areas of law that are complex or nuanced such as alter-ego claims, derivative actions, receiverships, injunctions, claim and delivery/replevin, contempt proceedings, evictions, execution upon judgments, and the Uniform Fraudulent Transfer Act. My clients have ranged from small businesses to Fortune 500 corporations to government agencies such as the FDIC, and they represent a broad variety of industries including gaming, sports and entertainment, banking and investment funds, solar energy, health care, manufacturing, aerospace, commercial landlords, taverns and nightclubs, and contractors and materialmen. I was a paralegal prior to attending law school, and continued working as a law clerk while pursuing my law degree as a part-time evening student. While in law school I also volunteered at a tenant's rights nonprofit organization and worked as a student attorney at my school’s legal clinic where I served as a guardian ad litem, presented guardianship petitions in court, and helped victims of domestic violence obtain temporary restraining orders. I remain strongly committed to pro bono service.

Jason Lather was born and raised in the tropical US territory of Guam. After graduating high school there, he enrolled at the University of Pennsylvania, where he was part of the second class ever of the prestigious Huntsman Program in International Studies and Business. Jason graduated from Penn with degrees in Business from the Wharton School and International Studies from the College of Arts & Sciences.. After returning to Guam for one year to fulfill his scholarship obligation, Jason found his way to Northern Nevada. He met Oksana, the love of his life, and they both moved to Reno to pursue educational and employment opportunities. Jason received his Masters of Business Administration degree from the University of Nevada-Reno while working in several industries, including gaming and distribution/logistics. He then discovered the small but interesting field of community management. Jason was one of the top community managers in Northern Nevada for five years, but he realized that he enjoyed one aspect of his job more than any other: THE LAW.. In 2008, Jason applied to one school, UNLV-Boyd School of Law. He was accepted with a full scholarship, and excelled at his studies. Jason graduated in 2011, in the top 20% of his class.. Jason and his wife welcomed their first son, Donovan, while he was in law school. Jason also began working as a law clerk, part time during the school year and full time during the breaks. Their second son, Nathaniel, was born two years later.. Jason has worked for several attorneys over the years, including some you've probably seen on TV or billboards. Along the way, Jason discovered a knack for litigation, especially for research and writing. One of his bosses called Jason "the best writer" he'd ever seen. While working for one of the largest injury firms in Las Vegas, Jason was the writing specialist -- writing every motion and pleading for the firm.. But Jason also wanted to do more than write. He wanted to make sure that his clients were getting the attention that they deserved. He also wanted to do more to help the community by doing pro bono work for those who could not afford to pay a lawyer. The only way to do all of that was to stop working for others and to be answerable to no one but himself.. Jason and his wife moved to Las Vegas thinking that they would only be here for three years. Over a decade later, Las Vegas is still their home.

Other verdicts Ben has obtained include a $15 million dollar jury verdict in 2016 on behalf of a family whose disabled son Harvey was allowed to choke to death on a paratransit bus. That verdict was upheld in a unanimous decision after four years of contentious appellate litigation with the final judgment ballooning to nearly $21 million dollars. The defense in that case never formally offered a single penny. After obtaining the verdict, Ben continued working on the safety issue that led to Harvey’s death and with the help of many other people got “Harvey’s Law” passed in Nevada in 2017, which required certain training for all paratransit bus drivers to ensure others were protected. In 2016, Ben also obtained a $12.9 million dollar jury verdict for a family whose life had been altered by a drunk driver that injured the mother and killed the daughter. He also obtained a $10 million dollar settlement for a client who was significantly injured from a fall which resulted in a moderate brain injury. Ben has obtained multiple soft-tissue, low visible property damage jury verdicts including a $2.98 million dollar jury verdict in 2018, a $1,075,000 verdict in 2014 and several 6 figure verdicts where Ben obtained verdicts over 180 times greater than the defense offers prior to trial.
