Firm: Cloward Trial Lawyers

In 2016, at the age of 37, Benjamin P. Cloward became the youngest lawyer in the history of the State of Nevada to be awarded the prestigious “Trial Lawyer of the Year” by the Nevada Justice Association. That same year, he became the youngest member of the Nevada, Las Vegas Chapter of ABOTA (American Board of Trial Advocates), and at the time was also the youngest person in the State of Nevada to be Board Certified as a Personal Injury Specialist. He has received many additional recognitions including being AV-Rated by Martindale-Hubbell and receiving a perfect 10.0 by . He has been featured in several magazines in Nevada for his accomplishments and hard work.. Just recently, in February of 2020, Ben obtained a $38 million dollar jury verdict, which is believed to be the largest ever negligent security for wrongful death in the State of Nevada and was the 2nd largest wrongful death verdict in the entire United States in 2020. Other verdicts Ben has obtained include a $15 million dollar jury verdict in 2016 on behalf of a family whose disabled son Harvey was allowed to choke to death on a paratransit bus. That verdict was upheld in a unanimous decision after four years of contentious appellate litigation with the final judgment ballooning to nearly $21 million dollars. The defense in that case never formally offered a single penny. After obtaining the verdict, Ben continued working on the safety issue that led to Harvey’s death and with the help of many other people got “Harvey’s Law” passed in Nevada in 2017, which required certain training for all paratransit bus drivers to ensure others were protected. In 2016, Ben also obtained a $12.9 million dollar jury verdict for a family whose life had been altered by a drunk driver that injured the mother and killed the daughter. He also obtained a $10 million dollar settlement for a client who was significantly injured from a fall which resulted in a moderate brain injury. Ben has obtained multiple soft-tissue, low visible property damage jury verdicts including a $2.98 million dollar jury verdict in 2018, a $1,075,000 verdict in 2014 and several 6 figure verdicts where Ben obtained verdicts over 180 times greater than the defense offers prior to trial. In addition to obtaining significant jury verdicts, Ben has also been involved in settling over thirty cases for values ranging from $1 million to $10 million as noted above. He has tried to verdict cases in both State and Federal Court in Utah and Nevada.. Ben successfully argued the Khoury v. Seastrand, 133 Nev. Adv. Op. 52 (July 28, 2016) case which was a huge victory for all injured Nevadans because it rejected the Howell-doctrine, which allows negligent people who caused harm to get a discount when they hit responsible citizens who carried personal health insurance.. Ben is a graduate of the famed Gerry Spence Trial Lawyer’s College and believes as does Gerry that “It all begins with you . . .” Ben served on the board for a nonprofit company called the Loa Fund, which focuses on providing financial assistance to those who struggle with addiction to receive help through wilderness therapy and other addiction recovery programs. Ben was raised in Salem, Utah. As a young boy Ben earned his Eagle Scout Award and after graduation from high school, he served a volunteer two-year mission for the Church of Jesus Christ of Latter-Day Saints in Louisiana. If you are facing criminal prosecution in Las Vegas, whoever you are and whatever the accusations, I can help you.. I have years of hard-earned experience defending criminal cases that range in seriousness from simple misdemeanors to felonies that carry life sentences.  I have handled every kind of criminal charge, from drugs to violence to theft and fraud and everything in between.  I defend clients from start to finish, from police investigation and arrest to formal charges all the way through trial and sentencing.  But I am willing to jump in and take over cases at any point, sometimes on the eve of trial.. I defend a diverse range of clients, from Las Vegas natives to visitors from across the United States and Canada and all across the world.  I represent clients with spotless records who are terrified of jail as well as multiple time felons who have done hard time and are hoping for a lucky break.  I have represented active duty military who made drunken mistakes and veterans who have trouble adapting to civilian life.  I represent people in the wrong place at the wrong time, people who fell in with the wrong crowd, people who made an impulsive decision with serious consequences, people with psychological disorders and physical impairments, and people addicted to drugs or gambling.  I represent people who admitted they were caught red-handed and people who are completely innocent. I represent men and women of every race, religion, sexual orientation, age, political affiliation, education level, and economic status.  I find it easy to connect with almost anyone and any client.  And I recognize that different clients have different needs and priorities.. I value creativity and the ability to adapt, so I am always looking for creative solutions and I vary my style and tactics based on the circumstances of each case.  I am a skilled negotiator and an experienced trial attorney, so I can quickly work out favorable deals in most cases, but if negotiations fail, I am willing and able to fight tenaciously to win your trial.  I am aggressive when I need to be and don’t tolerate unfair treatment of my clients, but I maintain good professional relationships in the criminal defense community and avoid burning bridges.  I don’t waste time with ineffective arguments or pick petty fights with opposing counsel, but I have no problem being the bad guy when I need to be.  I will not be polite at the expense of being thorough, and I will not treat a false accuser like a victim.. I give honest advice based on a careful evaluation of each case, and I can predict the likely outcome of many cases.  No two cases are exactly alike, but your charges aren’t new to me and neither are the facts of your case.  Whoever your prosecutor is, I’ve probably worked opposite him on dozens if not hundreds of cases, some just like yours.  Whoever your judge is, I’ve most likely appeared in his court more times than I can accurately estimate.  So while there are no guarantees, if you give me complete and accurate information about your case, I can tell you what results we can achieve.  I won’t try to scare you by overstating the worst case scenario, but I won’t promise you unrealistic results either.. I am proud of my successes as a criminal defense attorney.  I routinely negotiate quick and favorable deals to keep my clients’ records clean.  I have won not guilty verdicts in some very tough cases.  I have gotten more charges dismissed than I can remember.  I’ve saved countless men and women from prison.  If you are my client, I will use all of my talent, skill, and experience to get your charges dismissed or get you acquitted, or to work out a deal that keeps  your record clean without you ever setting foot in a courtroom.  Even if the evidence against you is strong and the charges are serious, I will work every angle to get you the best outcome possible and keep you out of jail or prison if I can.. Criminal charges are very stressful for defendants and their loved ones, and one of the greatest sources of stress is the fear of the unknown.  So I take time to answer my clients’ questions about their charges and the criminal law process and then I explain my plan to achieve the result we want.  I am always happy when I complete an initial consultation and a potential client tells me that I made her feel less worried about the future.. I tell clients that no matter what their charges are, the only way to handle their case is to take things one step at a time.  The consultation is always the first step.  Call me now to take that first step.  The rest is mostly up to me.  As I often tell my clients when they are feeling overwhelmed, I have gotten a lot of people out of a lot of trouble.  So I can help you too.

Finally I was able to get his murder case dismissed with prejudice, which means the state can never file another murder case based on these facts.. I'm from Beaver County, PA, and specifically Aliquippa.  Born and raised there. The whole area was blue collar and proud.  It was a shot and a beer kind of town. I can also say I am proud to have been raised there, and in those days I thought Aliquippa was the center of the world.  The J&L Steel Mill was pumping out steel and the related businesses were booming.  However, due to meeting the right person, the love of my life and present wife, Dawn, I moved from western PA so she could pursue her dreams on the stages of Broadway.  New York was a giant, crazy and busy city, but it was also a fun place to live.  New Yorkers in a sense were much like western PA people, in that they were tough but friendly.  It wasn't hard to strike up a conversation on the subway or in the bar.  Either way, Dawn's career took us from New York to Las Vegas in 1993.  What a change.  But, we liked Las Vegas enough to essentially call it home since 1993.. I grew up with the influence that education was the key to success.  My father, his two brothers, my two brothers, and several cousins are doctors.  They were all influenced the same way, and it all started with my grandparents who were immigrants with little education.  My grandparents knew hard work, but thought education would lead to a more successful and stable future.  As for me, I was not cut out for medicine, and like 3 of my other cousins, I choose law school.  But, I first had a career before law school, working in the medical field, wherein I ran a mobile breast cancer screening business before I got married.  Tri-State Mobile Mammography was a business that took its equipment to businesses that employed a lot of women and set up on-site for their convenience.  I was the business manager and my father the licensed physician who oversaw the medical aspect of the business.  After getting married, I left the business because I moved from Aliquippa. Eventually I ended up in law school in Los Angeles after my wife's gig in Las Vegas ended in late 1997.  I went to law school at Southwestern University School of Law and graduated in the top 15% of my class.  My first child, a boy, was born during my first year of law school and that, at least, doubled my work load.  But, it was worth every second.  Either way, after law school the family moved back to the New York area and I passed the bar exam in both New Jersey and New York. I worked in New Jersey for a year for a small firm doing mostly contract work and collections, but the family moved again after 1 year (too cold after 8 years out west) and we went back to Las Vegas in May 2001.  Another half year later and I passed the Nevada Bar exam and was a licensed attorney in the State of Nevada.. My career in Las Vegas started with the Christensen Law Firm, where I primarily handled plaintiff's personal injury cases. In late 2003, for personal reasons I left the firm and started my own practice, the Zernich Law Office. From 2003 until 2017, the Zernich Law Office grew to a small firm of 7 employees and we handled mostly family law cases, but I also kept up with the personal injury cases. My experience includes litigation and negotiation, motions, arbitrations, settlement conferences and trials and the representation of thousands of clients. I am confident to handle cases in all areas of both family law and personal injury. I am also interested in taking criminal law cases. Presently I work at the Roberts Stoffel Family Law Group with three of the best other attorney’s that I know.. I find being a lawyer very interesting, challenging but fun, sometimes frustrating, but always rewarding. I take my job very serious. Being a lawyer is a profession and I treat it that way. And, other than my family of 5, my work is the most important part of my life. But I do have a life outside of the courtroom and the office. For 13 years I've assisted my boy’s youth wrestling club or high school team and traveled with my 2 sons all over the country to wrestling tournaments. I often traveled with other youth wrestlers, taking them with me to tournaments in a used motor home that I purchased for that very purpose. I have one son left in high school, a State Champ wrestler with very good grades, and my older son is on the Dean's List at the University of Nevada Reno studying to be a doctor. My daughter, also in high school enjoys playing tennis and softball, and of course, keeping up her grades. My wife and I enjoy spending time together having a glass of wine, a bite to eat, or entertaining at our house. We can also be found a couple of times a week at the local gym or walking the Black Mountain hill for some exercise. Of course, this editorial wouldn't be complete if I didn't tell everyone that my family also includes four dogs, two cats, and seven chickens.. I hope to hear from you should you need a lawyer in the area of Family Law or if you are injured due to the negligence of another or need a lawyer after being charged with a crime.

I'm a native Nevadan. I have the ability to provide great representation to clients in a wide range of legal matters in a variety of different courts.  I have developed those skills from having a diverse history in various legal fields in starting with ciminal capital cases to representing debtors in chapter 7, 13 and 11 bankruptcies, to handling complex domestic cases involving large assets and children, to finally narrowing the practice to primarily personal injury, construction and business.  I founded and have manged my own law firm for over 26 years until I merged my practice with several different law firms both locally, regionally and nationally. After seven years of working in larger firms and learning from them I have decided to return to my own small boutique practice where I can work more closely with my clients and friends.  I have an active role in the community from serving as the chairman of the Henderson Planning Commission to coaching and refereeing soccer teams.  I also provide many hours of pro bono work and serve as a committee member for the Anthem County Club.
