My goal is to provide competent advice and solutions to difficult problems in a personal, caring and expedient way. I provide advice and counsel for all generations with a focus on the Elderly, but understanding that any generation can benefit from advance legal planning.. their issues. I handle all types of civil litigation related to money
owed, and money owing. That includes bankruptcy. If you are in debt, or
if someone owes you money, you call me for help. Likewise, if you are facing foreclosure, and want to pursue the bank - I am your man.I try to avoid
litigation, where possible, especially if  the client has an on-going relationship with the
potential defendant. However, I am perfectly comfortable taking a matter to a jury, and have participated in a number
of trials, including before a jury. I am willing to handle
business litigation matters on very short notice, particularly those
involving attachments or injunctions.. I
also serve as a resource for start-up businesses, providing counseling
surrounding incorporation, contracting, employee relationships, and
basic intellectual property issues.. I started my practice after having attended the evening program at
Suffolk University Law School. I worked all through school at several
Boston area firms where I received terrific training. Working as a solo
practitioner, I know I can provide tremendous value to my clients. It

Attorney Bretta also argued a case which appeared in Lawyer’s Weekly, in which she won an appeal before the Bankruptcy Appellate Panel, modifying a judgment against a bank in which a mortgage was improperly recorded against the incorrect property. Recently, she won an appeal before the Bankruptcy Appellate Panel involving a $2.1 Million Judgment against her client.. Ms. Bretta has also litigated several waiver and cancellation of removal cases in the United States Immigration Court in Boston, Massachusetts. The law firm was established in 2006.  We specialize in Estate Planning, Elder Law, Real Estate, and Business Law.. I grew up in Wakefield, MA, went to Wakefield High from 1990-1994.  I received the Salem State Presidential Scholarship for academics, and graduated Magna Cum Laude from the Salem State Honors Program in 1998 with a degree in criminal justice.  The most important thing that the criminal justice curriculum is that I never wanted to be a criminal lawyer.  I started Suffolk Law School straight out of college, determined to finish in three years, despite having to work nights and weekends.  I went to school with kids whose parents put them up in apartments around the corner from school, while I was either taking the train or fighting the traffic.  When I got out of class, I went to one of my two jobs, either the computer store in Woburn or the small Law Firm in Lynn.. Despite being exhausted most of the time, I graduated Suffolk after three years, in 2001.  I actually took the bar exam and got married all in the same week (bar exam on Wednesday-Thursday, Rehearsal Dinner Friday, and wedding Sunday) and still managed to pass on my first try.  I was sworn in to the Massachusetts Bar in January 2002.. My wife and I moved to Wilmington in 2003, and we have two children in the Wilmington school system.. I stayed on as an Associate with the Lynn firm until 2006, when I went out on my own, and opened the Law Office of Michael Monteforte Jr. in September 2006.  The firm started out as a General practice, handling pretty much whatever came in the door, but over the years, I started to concentrate on the specific legal fields that I found to be fulfilling and challenging.  I began to take continuing education classes that specialized in estate planning and elder law, and hones my expertise in those fields.  The firm underwent a name change incorporated in 2017, now called Monteforte Law P.C.  The firm specializes in Estate Planning, Elder Law, Real Estate, and Business.  For any other areas of law, we can provide referrals, but we are accepting new cases only in those fields of law.
