For fifteen years, I have practiced on the Western Slope.  My practice includes most civil matters – from real estate transactions and disputes, land use applications, water law, civil litigation, municipal law and homeowners’ associations.  I specialize in water law and municipal practice, and represent several municipalities across the Western Slope with regard to water matters.  My experience covers a broad range of clients and matters, whether it is prosecuting a complicated plan for augmentation through water court or negotiating the terms of a lease for a residential property.. I represent local governments in a wide range of matters and negotiates with local, state and federal governments on behalf of private clients.  I practice in the water courts for the Colorado, Gunnison, Yampa and Dolores river basins.  For homeowners’ associations I draft and enforce covenants as well as advise and adjudicate water rights.  In a real estate transaction, I have the depth of experience not only to review the title work and land use matters but also water rights and well matters – covering all matters of due diligence.  I work with developers and individuals in successfully navigating the land use process, whether it is all steps necessary to receive subdivision approval or to receive a building permit.  I also represent contractors, subcontractors and materialmen in mechanic’s lien actions, construction defect and payment disputes and conversely can represent owners with regard to the same.  I assist with business formation and organization.

Since commencing the practice of law in 2009, Sean has been a trial lawyer who has represented both claimants and defendants in complex construction defect and professional liability litigation. Prior to joining Vial Fotheringham, Sean worked for a respected Denver plaintiff’s construction defect law firm prosecuting claims on behalf of homeowners, homeowners associations and commercial clients. Sean has represented numerous claimants in the successful resolution of lawsuits ranging in value from $100,000 to over $750 million, including a municipal entity seeking to recover for design errors and omissions in a wastewater treatment facility. Sean has also gained experience defending contractor and developer clients from construction defect lawsuits while employed at a mid-size insurance defense firm. His experience representing insureds in third party claims has proven valuable when representing plaintiffs seeking judgments in excess of policy limits. Prior to attending law school, Sean obtained extensive experience in construction trades which provides him with a unique and valuable perspective for a construction defect attorney.

I primarily practice in the area of insurance defense. I have defended all disciplines in construction litigation. I have defended property owners, manufacturers, transportation companies, as well as small and large corporations in property, casualty, advertising injury and personal injury matters. I have written an Amicus brief for the Colorado Subcontractor Association. I have given presentations at CLE seminars on subjects ranging from employment in the public sector, to using experts and preserving evidence, to updates in construction law. I am a founding member and past co-chair of the Construction Committee of the Colorado Defense Lawyers Association. I provide expert opinions in attorney-fee matters and have been qualified as an expert witness in a variety of district courts in Colorado on the topic of attorneys fees and standard of care. I am general counsel to a handful of corporate clients as well as non-profit businesses that provide services to developmentally disabled clients and at-risk youth. I also serve as a mentor to University of Denver Law School students, and I am an active participant on Channel 9 News’ legal assistance program LawLine 9.
