Landlords with ESA’s

landlord tenant attorney North Dakota Aug 10, 2026
i’m in kind of a weird situation right now. I moved into a new apartment three months ago, and my dogs have been adjusting with separation anxiety. My dogs are absolutely fine when I’m at home, but if I’m at work and I don’t have somebody to watch them. They do go on barking spurts. This is a pet friendly apartment, but I did not have to pay pet rent because my dogs are registered ESA’s. When I first moved in, I had worked a couple days without them having a babysitter and I got a lease violation that said i had one day to fix the issue two weeks into me living there for dogs barking. I was confused cause I didn’t have a warning they said that they had emailed me one. This was completely understandable as I know my dogs were kind outrageous so I started having somebody watch them for the entire entirety of the time that I left the house, but they could not do that for the past two days that I worked. I’ve gotten them non-shocked dog collars that vibrate when they bark I stuff treats for them before I leave the house every time I turn the TV on, and I give them calming treats, and I’ve honestly noticed a lot of progress. I got a text two hours into my shift at work yesterday saying that if I was not home in 20 minutes to stop my dogs from barking, they were gonna have animal control come remove my dogs and then they said that they were giving me a warning that I will be getting another lease violation on Monday and I will have to remove my dog from the premises. I do not leave my dogs alone. I do not leave my house at night. They were barking at 2 PM in the afternoon. I just wanna know what my options are here as this is my first place living alone. I feel like they are targeting me just a little bit for example also right after my lease violation when I first moved in I had walked my dogs and picked up their poop ( as always) I got a text that afternoon stating that I had missed a “ little piece“ I apologize and said it won’t happen again. I just don’t know what to do in this situation. My lease isn’t up for another nine months. Location: North Dakota
