Motorcycle wreck dui

When driving my motorcycle through a turn I hit a patch of gravel causing me to low side my motorcycle. I broke my collarbone in two places in both of my hands and some ribs. I was an extreme pain laying there couldn't move couldn't find my phone when somebody pulled up and helped me. I had blood and dirt and whatever else in my mouth and needed to drink something. The previous day we were at the river drinking whiskey and Coke. I didn't want to waste the whiskey that we had left over so I poured it into a thermos. I did not know that thermos was still in my bag. The people that pulled over to help me opened the thermos and help me drink it I realized it was whiskey but was in so much pain I didn't care because it was after the crash it shouldn't matter right. Wrong they did a blood test on me about an hour and a half later and it was .09. luckily I exchanged numbers with the people that pulled over. They arrested me in the hospital and took me to jail. I know I will be charged with open container. I'm using voice text to type so excuse the typos please. I hired a very good lawyer. My question is does the witness have to come to the court to provide a statement that they see me drink after the fact or do you think a written statement would be good enough. Considering we're all strangers I doubt that would take the time to come all the way to court and go through all the hassle. Location: South Carolina
