Location: Raleigh, North Carolina Hi all, I need some advice on next steps here, as I can't seem to get a local attorney to take a paid consultation at the moment. This is regarding tenancy rights in North Carolina / early lease termination / delivery of premise Our lease in Raleigh North Carolina began on August 1. WE relocated from another state on the 13th, and arrived at the house late on the 14th. Upon entry of the home the house was left filthy from previous tenants, and lack of landlord cleaning. Dead roaches in all bedrooms / live roaches. Mold in the bathroom on window sill, and on the ceiling along with pealing / failing paint around moldy areas. Dirt and buildup on all crown molding / trim from years of neglect / cleaning from previous tenants. Human and animal hair throughout the house, and toilet left in unsanitary conditions around exterior of toilet and flooring. The windows do not properly seal / close throughout the home as they are very old windows. The ac receivers that blow forced air into the home are "ajar" and not connected to their brackets and just sitting to the side n different locations of the home. The home reeks of cigarettes and animals. The flooring is 3 layers of linoleum flooring and is peeling up across the kitchen and dining areas. In the corner of the dining room area the flooring was peeling up particularly bad so I lifted the flooring up and there is a hole in the plywood subfloor and mold / water damage around the area and you can see into the crawl space. My concern is moving into the home with a small child. We didn't actually move into the home and instead unloaded all of our belongings into a storage unit notified the landlord of our complaints and have been in a hotel since then. They had said they would clean the house / deep clean but did not indicate weather they would fix the flooring or not. I have notified as well saying I want to mutual terminate the lease to much hesitation and resistance as they want to keep me on the lease as tenant is legally obligated to continue rent payments apparently in North Carolina and cannot withhold rent without a court order. Things I have done is contact the landlord in a written form immediately upon entry of the home with all complaints and currently scheduling an official housing visit for an inspection from the city of Raleigh. Currently on hold with free legal aid but I know I won't qualify for it. I just want to get out of this lease and move into another home as my daughter is starting school next week here and this is seeming turning into a nightmare. The landlord did re-list the home this Sunday which I know they are legally obligated to do just wanted to mention that as well. Any advice is more than welcome here or resources pointing in the right direction. I have contacted 6 different law firms and no one will even take a consolation with me for unknown reasons even when stating will more than compensate them and pay for any time given no matter the costs. Just need to get out of this hotel and into a home. I do not want to live in this home at all as I have lost all faith in the landlord.
