Estranged father claiming sibling's inheritance.
probate attorney Oklahoma Jul 27, 2026
Location: Oklahoma Mom passed 6 years ago unexpectedly; no will. She and dad were divorced. There are four kids, I'm the oldest and executor of the estate. Youngest sibling was a minor until recently, so we didn't move forward on dividing the house as an asset until they were an adult. Everything thus far was split evenly four ways; only the house is left. Dad's name is on the mortgage, but the divorce decree says he had no legal right to the house. Last year my younger sister died, unmarried, with no children. Now we are trying to start the probate process on the house, and dad has sprung it on us that he intends to collect sister's share of the equity. Sister hated him; Mom hated him. Rest of the siblings are normal grown-ups but he's totally going to make this a nightmare. Wondering about any legal precedent for this?
