I have practiced commercial/business litigation since graduating from BYU law school in 1976. Tried more than 100 jury trials. I love the courtroom. I prepare and trial cases electronically because it increases efficiency and lowers costs. All client documents are scanned and bates-labeled, so that complete chronologies can be prepared. A chronology is vital to understasnding the case and preparation. It, also, allows for designation of trial exhibits and preparation of exhibit lists using the computer rather than hand-sorting and hand-description of exhibits. Exhibits can be annotated electronical for effective trial work, and I use the computer equipment in the courtroom myself: there is no disconnect between the examination and getting the document on the screen for the witness, jury, and judge.. Computer images are used in depositions rather than paper exhibits because of the increased efficiency and the resulting lack of disconnect when depositions, which I always videotape, are played at trial. The talking head and the document can be displayed for the jury, and the bates number assures the jury that the same document marked and used at trial is the one about which the witness is testifying. The images allow a free-ranging deposition rather than one limited the stack of documents on the table.. We have the necessary computer programs to process native-file electronic documents (ESI or electronically stored information). Metadata is essential in many cases. We, also, have the right computer forensic help for imaging and use of client and adverse-party computers.. My longest jury trial lasted ten months, a securities fraud trial with more than 10,000 exhibits marked. It was eash to manage becuase of technology. My largest jury verdict resulted in a judgment of more than $60 million. I have traveled internationally for cases and, of course, all over the United States. Tried cases in many states.. I was an adjunct professor of law at ASU lawschool for two years teaching electronics in the courtroom.. I have done cases on a budget and cases where the amount at issue was such that there was no budget. My fees tend to be less than other lawyers because of the efficience of the electdronics used for prepartion, management, and trial. I, also, expect the client to help me know where to look for evidence in the field of discovery so I do not have to turn over rocks where there are no worms.. I have an economics degree, which helps in the sorts of cases I try. Cases that generally involve economic and accounting experts. It is easier to prepare an expert or cross the other side's expert if you have background in the subject area.. I have a commercial pilot's license with more than 4,000 hours of flight time, less than 80 hours of which is in single-engine aircraft. I know airplanes, the FARs, and all things aviation, so there is no or very little learning curve when the case is aviation related. I have represented pilots, FBOs, Part 135 operators, and Part 145 repair stations.. I am a trial lawyer. That means I want to try the case. My job is to get the case ready to try and try it, not ready to settle. I am at home in large-document cases involvintg complex legal issues. I prefer the courtroom to the office. Interviews, discovery, and everything pre-trial (office work) is to get me to the courtroom.
I am primarily a business litigator. However, I have litigated a wide variety of cases including construction defect, mold and toxic tort, bad faith, medical malpractice, long-term care liability, securities fraud, personal injury, insurance defense, trade secret and intellectual property litigation. I have served as first or second chair in seven jury and one bench trial and have handled numerous evidentiary hearings, including an 11-day Frye hearing on the admission of scientific evidence. As a judge pro tem, I have handled civil, criminal and juvenile matters for the Maricopa County Superior Court and the Gilbert Municipal Court. I have presided over approximately 15 jury trials and two bench trials as well as numerous civil traffic hearings. I have conducted approximately 60 court-ordered settlement conferences and 5 arbitrations. I also handle arbitrations and mediations as a paid, third-party neutral.I also serve as the Chair of the firm's VISION Outreach Program in the Firm's Phoenix office. The Polsinelli Shughart VISION Program (Volunteers Investing Service In Our Neighborhoods) is a way of giving back to the community while taking advantage of an opportunity to broaden and deepen personal relationships with colleagues. The VISION Leadership Team coordinates a variety of volunteer opportunities for teams of Polsinelli Shughart employees to serve the needs of a number of local charities. In 2012, the Phoenix office partnered with UMOM to help meet the needs of newly homeless families. In 2013, Polsinelli's Phoenix office will continue to work with UMOM while also expanding its services to other local charities.Specialties: The Arizona State Bar prohibits attorneys from claiming specialties under most circumstances. I am a Boston native and a Harvard Law School graduate and have been 41 years in Phoenix. I am a litigator and my practice is mostly construction law and real estate law, with a large amount of service as a mediator and an arbitrator. Most of the cases in which I serve as either are construction law based, but many have business law and real estate law components as well. I have mediated 90 cases in the last 12 years, some for AAA but many as a private mediator. I am fluent in Spanish and recently handled an arbitration in which one side testified in Spanish and I asked questions of the witnesses in that language. I am listed in Best Lawyers, Top Litigators, and have recently been named in a list of Arizona's 50 top lawyers. I do a lot of extra-curricular work and am head of the ADR Section of the State Bar this year, serve on a City of Phoenix Task Force regarding Budget Issues, serve as head of the Quality Care Committee for St Joseph's Hospital (where I am in my third year on the Community Booard of the Hospital, and am involved in using Probationer labor to do construction repairs on buildings owned by charitable coprporations. I always welcome discussion about any case. If I'm not the right "match" for your needs, I will be up-front and will point you in another direction. I want people to find the right lawyer for the right purpose, and I'm always willing to refer to others. But I'm also hopeful that our Firm is right for you & can get you the results you want. Feel free to call or email me with your questions - no matter what!. Our firm specializes in Business Law - both litigation and transactions. Personally, I handle commercial matters, civil cases, and criminal defense. I also do Mediation/Alternative Dispute Resolution. Ronan & Firestone is a great group of lawyers -- both professionally and personally, and I am more than excited to be the newest "partner" in the group. My personal aspirations include: 1) Making my clients satisfied with their representation; and 2) Maintaining the best possible service I can provide. I do not keep financial goals, as finances are only a fringe benefit of law practice for me. My passion lies in helping people and fighting for justice -- not in getting rich. But, of course, the occasional $1 Million verdict/settlement is always welcomed! Someday I hope to be a partner of Ronan, Firestone, Manolio-Deden. For now, I'm happy to enjoy life as a competent litigator and member/partner of the Firm.
Hi! I am a second-generation estate planning attorney with over two decades of experience, and I have seen how even the best intentions can have negative results. Without considering estate planning, family members can be left in confusion, turmoil, or worse, after a loved one passes.. That is why my focus is on creating comprehensive estate plans that fulfill the wishes of professionals, business owners, and retirees to enable a transition that protects the remaining beneficiaries.. My vision is simple and powerful: provide every client with an exceptional legal planning experience. With a decade spent in the courtroom as a trial attorney, I understand how to help clients and their families protect against predatory lawsuits and stay out of court.. I have been featured in the media as an estate planning authority, including ABC News, NBC News, FOX News and Bloomberg Law.. When not at the office, I enjoy spending time with my wife, seven children and grandchildren. I love the outdoors and am an avid wilderness backpacker - I have even backpacked to the bottom (and back out!) of the Grand Canyon 14 times.
