Brice Timmons divides his practice primarily between the areas of Civil Rights and Education Law.. Mr. Timmons represents plaintiffs in numerous types of civil rights suits against jails, prisons, police, and private prison contractors. Mr. Timmons has obtained substantial settlements for clients due to false arrest, false imprisonment, and poor medical care while incarcerated. He is especially interested in cases involving so-called “mistaken-identity” arrests and refusing to provide medical care to inmates. He has represented clients in other types of cases brought under the Fourth, Fifth, Sixth, Eighth, and Fourteenth Amendments and 42 U.S.C. Section 1983 of the Civil Rights Act.. Mr. Timmons represents children in suits for civil rights violations arising under the Americans with Disabilities Act, the Individuals with Disabilities Education Act, and other civil rights statutes. In addition, he has represented both adults and minors with mental and emotional disabilities against their caregivers. While children are a vulnerable population, disabled children outside of their parents’ care are especially vulnerable to civil rights violations, malpractice, and neglect and abuse. Mr. Timmons has represented such children in unique and extreme cases including suits involving group homes, intermediate care facilities, schools, and so-called “troubled teen industry” facilities.. He is one of only a handful of attorneys to have obtained injunctive relief barring the expulsion of a college student accused of sexual misconduct under Title IX, successfully arguing that the school denied the student due process. Mr. Timmons represents students and advises families in addressing all manner of student discipline cases including sexual misconduct. He also represents students who are survivors of sexual assault and harassment as well as other forms of discrimination in suits against K-12 schools, colleges, and universities.. Mr. Timmons received a B.A. in Political Science from the University of Memphis. He earned his Juris Doctor degree from the University of Memphis, Cecil C. Humphreys School of Law. Mr. Timmons has served as a member of the Graduate Faculty of the Department of Political Science at the University of Memphis. He is a member of the Memphis Bar Association, Tennessee Bar Association, and American Bar Association. He currently serves as the chair of the Shelby County Veterans Court Foundation – an organization devoted to giving veterans a path out of the criminal justice system and a second chance.. Mr. Timmons served in the 173rd Airborne Brigade of the United States Army. He focuses his pro bono practice on helping survivors of domestic violence and sexual assault as well as on jail and prison conditions reform.
