I was born in Knoxville, Tennessee on February 25, 1968. He received his Diploma in 1986 from Montgomery Bell Academy, his Bachelor of Arts in Political Science in 1990 from Rhodes College, and his Doctorate of Jurisprudence in 1993 from Memphis University. While attending Memphis University, he served on the Memphis University Law Review and Moot Court Board. I was admitted to the Tennessee bar in October of 1993. I have been lead or junior counsel as plaintiff’s attorney in over 20 medical malpractice trials.. A special area of focus at our firm is helping clients who have suffered due to medical malpractice. There are all sorts of ways you may have been hurt or lost a loved one: a surgical mistake, birth injury, medication error, or misdiagnosis (of heart attack, stroke or cancer). No matter what happened, I and my staff are here to help.

I believe the law can empower the powerless by providing a fair hearing on a level playing field for everyone regardless of wealth and social position. Unfortunately, sometimes the greatest benefit I can provide a client is to explain why I do not believe they have a case. I try to fairly evaluate each case I have the privilege to review and work to vigorously represent those clients I feel I can benefit. My philosophy as a lawyer is to use my legal knowledge to help people who need help.

Brian Cummings has 20+ years of litigation experience, including successfully handling and trying scores of medical malpractice and personal injury cases.. Brian has recovered more than $24,000, for his clients in just the past few years, which earned him Lifetime Member status in the Multi-Million Dollar Advocates Forum, an organization whose membership is limited to trial lawyers who have won multi-million dollar verdicts and settlements. Selection is based on strict standards, recognizing only trial lawyers who “have each demonstrated, in an objective and tangible way, their ability to accomplish superior results in complex cases.” Fewer than 1% of lawyers in the United States are members.. Brian was selected as a SuperLawyer in Personal Injury law and in Medical Malpractice law for five straight years fro 2015-2019.. Brian is Board-certified as a Medical Malpractice attorney by the American Board of Professional Liability Attorneys. He is 1 of less than 20 attorneys in Tennessee who have earned this certification. Board-certification is awarded only after having one’s trial experience vetted and passing an extensive written exam.. Brian was selected in 2017 and 2018 by The National Law Journal as an Elite Lawyer of the South. This award is given to the Top 5% of lawyers in their practice area.. Brian was selected by The American Lawyer for the Best Lawyers in Medical Malpractice award in 2015.. Brian has the highest rating available for attorneys from Martindale-Hubbell, having been designated as AV Preeminent. The AV rating means a lawyer’s peers (attorneys/judges) rank him at the highest level of professional excellence.. Brian is a Member of The National Trial Lawyers: Top 100 Trial Lawyers. This is an invitation-only organization composed of the premier trial lawyers from each state who meet qualifications as a top plaintiffs’ lawyer. Selection and invitation are based on a thorough multi-phase process which includes peer nominations and third-party research. Membership is extended solely to the select few of the most qualified attorneys from each state who demonstrate superior reputation, leadership, influence, stature, and public profile.. Also, Brian is a Fellow of The Litigation Counsel of America (LCA). The LCA is a trial lawyer honorary society composed of less than one half of 1% of American lawyers. Membership is by invitation only. Selection is based on effectiveness and accomplishment in litigation, as well as ethical reputation.. Brian has multiple jury trial successes, including a recent $1.1 Million verdict in December 2018, and he has obtained strong settlements for his clients. He makes a point to develop themes and exhibits to share with juries to complement the concise, jury-friendly, and story-telling style he uses at trial. Brian speaks frequently at litigation seminars by invitation, with the most common request being that he share with other lawyers his insight and experience regarding how to prepare and present the best arguments and stories to persuade juries.. Brian is licensed to practice law in Tennessee, Hawaii, California, Georgia, and Florida. He is also admitted to practice before the United States Supreme Court, the United Stated District Court of Hawaii, and the United States District Court of Middle Tennessee.

I believe in hard work, exceptional client communication, and finding creative and cost-effective solutions.. Since joining Hodges, Doughty & Carson in September 1997, I have represented physicians, nurses, hospitals, assisted living facilities, mental health centers, and other healthcare providers in state and federal courts, as well as state administrative proceedings. I have acquired extensive experience in state and federal trial courts in Tennessee and Georgia, as well as appellate representation before the Tennessee Court of Appeals, the U.S. 6th Circuit Court of Appeals, and the Tennessee Supreme Court.
