Primarily, I work for people with disabilities and their families. I've been helping families obtain guardianship and conservatorship when their disabled child reaches the age of majority, or when family members become incapacitated through traumatic brain injury, Alzheimer's or dementia, or some other malady. I also help these families apply for their entitled government benefits, such as Social Security Disability, Supplemental Security Income, Medicaid, and Medicare. After obtaining government benefits it can be critical for families to establish a special needs trust in order to protect their benefits or assets; I help families in the establishment of these trusts as well.. The area of law these legal services encompass is called probate. Probate law seeks to answer questions relating to a person's death or incapacity. Probate law deals with both estate planning (wills, trusts, powers of attorney, etc.) and what to do in case someone dies or becomes incapacitated without an estate plan in place (guardianship, conservatorship, opening and closing the probate estate, etc.). I've been working in the probate arena for seven years and practice all forms of estate planning and probate litigation.. Helping families in Social Security cases does not fall under probate law, but are disability related and I have made this part of my practice as well.
