A finding against an insured was improper where, in order to take a personal injury protection reimbursement, the insurer was required to pay a pro rata share of the legal expenses incurred by the insured to arbitrate the uninsured motorist claim.. Sundquist v. Bre Properties, Inc., United States District Court for the Western District of Washington Case No. C11-0209-JCC. A landowner has an affirmative duty to maintain common areas in a reasonably safe condition. The duty extends to the removal of snow and ice and is based upon the tenant’s expectation that the premises have been made safe for the tenant’s use. The Court held a Plaintiff may prevail on her negligence claim by showing either actual or constructive notice of the unsafe condition or that the unsafe condition was reasonably foreseeable.
