This case resulted in a verdict in favor of Michele’s client, including the recovery of substantial attorneys’ fees and required affirmative relief for the employer who had wrongfully discriminated against and discharged Michele’s client. It was one of the first reported PTSD and Veteran-related discrimination cases reported in Montana.. During the course of this litigation, Michele began to fully understand and appreciate the challenges faced by individuals who have been discriminated against in the workplace, as well as those that have been wrongfully terminated. She also saw, first-hand, the emotional and physical toll that victims and their families experience as a result of unlawful conduct by others.. At the same time as she was handling this discrimination case, Michele was also representing a disabled woman who had been sexually assaulted within an assisted living facility. This case also greatly impacted Michele, as she helped the family navigate both a complicated legal situation and a highly-emotional victimization. Both of these cases, as well as others in which she represented various individuals gravely in need of help, solidified for Michele that her legal skills had to be, moving forward, more consistent with her values and passions.. These values and passions are ones that Michele developed at an early age. Growing up in the foster care system, herself a victim of abuse and assault, Michele decided early on that she was not going to be “one of the statistics.” Her singular goal was to build a life for herself, and eventually, her own family, that was dramatically different than what she herself had experienced as a child. Elinor Swanson ("Ellie") graduated from Lewis & Clark Law School. She was an editor for the Lewis & Clark Law Review. Ellie has interned for U.S. District Court Judge Paul Papak, the Multnomah County Attorney’s Office, and the Lewis & Clark Legal Clinic. Ellie's academic legal article was published in Volume 32 of the Hofstra Labor & Employment Law Journal. She joined Paul Warren Law, PLLC, a personal injury law firm, in 2015.
Douglas Day has lived in Montana since 2001 when he and his family moved to Missoula to enter Law School at the University of Montana. Before that, Douglas completed a bachelor of science double major in biochemistry and cellular biology from the University of California, San Diego. It did not take long to fall in love with Big Sky country. After law school, his family moved to Lewistown to clerk for the 10th Judicial District Court for a year. Douglas then joined the Office of Public Defender as a Regional Deputy. He has served as the Regional Deputy for the past 11 years, managing attorneys and clients for 11 counties in Central Montana.. During his time serving as the Regional Deputy, he completed advanced courses in Trial Advocacy and became certified to defend Capital Crimes. In 2007, he received the Governor’s award for Excellence in Performance as well as the Montana Department of Administration’s Team of the Year Award. In 2013, Douglas received the Excellence in Leadership Award for the Montana Office of Public Defender. He has also served as a Fellow for national review of public defense.. Douglas has based his career on serving others and helping them make the most out of their situation. He serves actively in his church and community. Douglas loves playing board games with his four children, reading young adult fiction, being outside, and running marathons with his wife. In 2007, his family created a nonprofit organization for youth fitness that serves children in Central Montana. The entire family enjoys coaching, managing, participating, and instructing fitness, as well as caring for their facility to promote fitness and fun. Douglas zealously represents his clients with compassion. He looks forward to continuing his service with Central Montana Families.
